CERTAIN REAL PROPERTY ON DUARTE ROAD BETWEEN HOLLY AVENUE AND LA CADENA AVEh~ FRCM ZONES R-l AND R-2 TO ZONES R-2 AND R-3. \JRERE.'\S, an application \'1:103 filed on December 2, 1957, si~n~d ~y Jum~~ H. Sor~ anct others, as owners, for :l. r~classifica- tion of certain pr'operties on the northerly and southerly sides of Dual'te ,'toad be;tv!e,m Holly Avenue and La Cadena Av"m..li: in the City of Arcadia; and, ~,HEREAS, this Commission was of the opinion tilat consid- . eration Should be given to the reclassification from Zones R-l and R-2 to Zones R-2 and R- 3 of all the prop~rty on tile northerly and southerly sides oj~ Duarte Road between Holly Avenue and the present commercial zone ni~ar Haldwin Avenue, in the City of Arcadia, County of Los Angeles, S';ate of California, described as follows, to wit: Lots 43 to 55, inclusive, Tract No. 3430, as ShOl"ffi on map recorded in Book 42, page 32, of Naps, in the office of the Los Angeles County 3ecorder; and Lots 1 to 4, inclusive, Tract No. 8487, as shown 0:"1 map recorded in Book 114, page 4.8, of Maps, in the office of said County Re- corder; and . Lot 2, and that portion of Lot 1, Tract No. 4090, as sho\"m on map recorded in Book 43, page 47, of Maps, in the office of said County Recorder, lying north of Tract No. 6548, as ShO\'ffi on map recorded in Book 82, pae;e (~5, of Maps, except that portion of Lot 1 beginnin~ at the southwest corner of Duarte Road and Holly Avenue; thence south along the west line of Holly Avenu~ 350.45 feet; thence West 277 feet; thence North 306.56 feet to the south line of Duarte ;{oad; thence Northeast there- on 280.48 feet to the point of beginning, and did therefore on its own motion, under and by Resolution No. 282, institute proceedings for such purpose; and, -1- 299 . . . viHEREAS, after notice required by Ordinance !{o. 760 of' said city, as amended, a public hearing was duly held on each of said matters by and before this Commission on the 13th day of Nay, 1958, which hearing ~a8 duly continued to May 27, 1958, and still further duly continued to June 10, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOVi, THEREFORE, THE CITY PLANNING COlvrr-HSSION HEREBY DETER- MINES A}ID RESOL~, AS FOLLOWS: . SECTION I. That there were protests, both oral and writ- ten, to the requeElted and proposed reclassification, some on the grounds that cOIT'.mt~rcial rezoning was desired; that there were let- ters favoring the granting of such rezoning as well as those who spoke in support of the change. SECTION 2. That subject property is bounded on the north by the rear of 101;s facing Fairview Avenue pl'esently zoned R- 3 and on the west by 0-3 zoning. That a variance and special use permit have already been granted for a mortuary on a portion of subject property and therle are two churches in the area under consideration. That various sect:lons of Duarte Road have commercial zoning and have already been so developed. That Duarte Road is a havily trav- eled street and no longer suitable for restricted residential zon- ing. That most of subject property consists of deep lots which not only could be mor3 profitablY developed with R-3 zoning but with proper street access could be divided. . SECTION 3. That for the foregoing reasons this Conunis- sion recommends to the Arcadia City Council that upon the dedica- tion f'or the widening of Duarte Road of the Northerly 12 f'eet of the property hereinafter described, the following descrioed real property be rezoned to R-2: -2- 299 . . . ~hat par~; of Lot 1, Tract No. 4090, as shown on map r~ocorued in Book 43, page 47, of I.laps, in the o:;'fice of the Los Angeles County Re- cox'der, des.;:ribed as follm1s: 0.91 Acres commencing South Blo I'Jest 280.51 feet from northeast corner of Lot 1, thence South 810 WeEt 77.98 feet; thence South 506.52 fj~et; thence South 89059'20" East 77 feet; thence North 518.72 feet to be- ginninG; that upon the dedi~ation for the wideni~ of Duarte Road of the Fortherly 12 feet ~f the property he~einafter described, the fol- lowine described real property be rezoned to R-3: Lots 1 to 4, inclusive, Tract No. 84b7, as shown on map recorded in Book 114, page 48, of Maps, in tbe office of the Los Angeles County Recorder; . that upon the dedication for the tlidening of Duarte Road of the Northerly 12 feet of the propert;y hereinafter described, the fol- lowing described real property be rezoned to R-3: Lot 2, Tract No. 4090, as shown on map re- corded in Book 43, page 47, of Maps, in the office cf the Los Angeles County Recorder; that the following described real property be rezoned to R-3: Those portions of Lot 1, 'l'ract No. 4090, as shown on map re- corded j.n Book 43, page 47, of Maps, in the office of said recorder and described as follows :: Lot commencing North 90 feet from the north- east corner of Lot 17, Tract No. 6548, thence North EO feet with a ',miform depth of 277 feet NOl~th 89059 '20" t'lest; Lot comnencing at northeast corner of Lot 17, TraGt No. 6548, thence North 90 feet wi th a lmiform depth of 277 feet North 89059120" \'lest; . that upon the dedication for the widening of Duarte Road of the Southerly 12 feet of the property hereinafter described and upon the condition that Arcadia Avenue be opened between Baldwin Ave- nue and La Cadena Avenue, that it be located at the rear line of -3- 299 ~. . . subject lots on the north side of Duarte Road west oJ: La Cadena Avenue, and that s~id opening and improvement be at the expense of the property owners, the following described property be re- zoned to R-3: Lots 43 to 48, inclusive, Tract No. 3430, as shown on map recorded in Book 42, page 32, of Maps, in the office of the Los Angeles County Recorder; that upon the dedication for the widening of Duarte Road of the Southerly 12 feet of the hereinafter described property, and. upon the condition that Arcadia Avenue be opened between La Cadena Ave- nue and Holly Avenue, that it be located at the rear line of sub- ject lots on the north side of Duarte Road between La Cadena Ave- nue and HOlly Avenue, and that said opening and improvemellt be at . the expense of the property owners, the following described ~rop- erty be rezoned tc' R-3: Lots 49 to 55, inclusive, Tract No. 3430, as shown on map recorded in Book 42, page 32, or Naps, i,l the office of the Los Angeles County Recorde.~; t11at upon the dedj.cation for the widening of Duarte Road of the northerly 12 feet of the hereinafter described property and upon the condition that a street be oyened east of the Lutheran Church I'Ulming south from Duarte Road and turning east to apprOXimately parallel LeRoy Avenue, with a suitable connection to LeRoy Avemle to ~rovide an access to the deep lots on the south side of Duarte Road, the south l:Lne of said street to be located apprOXimately 100 feet north of the south line of said lots, to allow new lots on each side of the street, and that said opening and improvement . be at the expense of the property owners, the following described property be rezoned to R-3: That pO'rtion of Lot I, Tract No. '-1.090, as shCJwn 0,:1 mal> rec orded in Book 43, page 47, of r~ps, in the office of the Los Anseles -4- 299 . . . County Recorder, lying north of Tract No. 6548, excepting therefrom the Easterly 384 feet; and excepting therefrom the south- erly portion, being approximately the south- erly 260 feet of the westerly 829.85 feet of the easterly 1213.85 feet; and that the following described property remain in Zone R-l: The southerly portion, being approximately the southerly 260 feet of the westerly 829.85 feet of the easterly l213.85 feet of that fart of Lot 1, ~ract No. 4090, as shown on map recorded in Book 43, page 47, of Maps, in the office of the Los Angeles County Recorder, lying north of Tract No. 6548. SECTION 1. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia. .
