RECOMMENDING THE GRANTING OF A VARIANCE TO PERMIT THE ESTABLISHMENT AND MAINTENANCE OF A TRACT SALES OFFICE AT THE INTERSECTION OF EIGHLAND VISTA DRIVE AND CANYON ROAD. WHEREAS, there was filed with this Commission on the l~th day of May, 1958, the application of the George Elkins Company, agents for Camden-llilshire Company, signed by George W. Elkins, for a zone variance to permit the establishment and maintenance of a tract sales office for the purpose of selling lots in Tracts Nos. 23143, 23144 and 2;3l45, on property in the City of Arcadia. County . of Los Angeles, St.;J.te of California, described as Lot 22, Tract No. 23144, as shown on map recorded in Book 624, pages 61 and 62, of Maps, records of Los Angeles County, located at the southwest corner of the intersection of Highland Vista Drive and Canyon Road; and, ~{EREAS. after notice required by Ordinance No. 760 of said City, as amer.ded, a public hearing was duly held on the matter by and before thiE: Commission on the 27th day of ~1ay, 1958, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW. THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: . SECTION 1. That there were no protests, either oral or written. to the granting of the variance. SECTION 2. That there are exceptional circumstances ap- plicable to the intended use of the property that do not apply to other property in the same vicinity in that to be effective a tract . ;. -1- 295 t- . .. . . sales office must be located in the immediate vicinity of the tract lots to be sold. That such variance is necessary for the preserva- tion and enjoyment of substantial property rights of the applicant inasmuch as applicant is the owner of extensive properties being subdivided and sold and a tract sales office is necessary for the proper handling of subdivision lot sales. That the granting of the variance requested will not be materially detrimental to the public welfare, or' injurious to the property or improvements in such vicinity and zone, nor will it adversely affect the comprehen- sive general plan if the variance is granted for a limited time only. . SECTION 3. That for the foregoing reasons, this Commis- sion recommends tel the City Council that a variance be granted to permit the establishment and maintenance of a tract sales office upon the above-deflcribed property for a period of two (2) years after the effective date of the variance hereby recommended. SECTION 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
