A RESOLUTION OF THE CITY PLANNING COM/lUSSION OF THE CITY OF ARCADIA, CAL;:pORNIA, RECOMMENDING THE GRANTING OF AN APPLICATION FOR A SPECIAL USE PERlUT FOR THE CONSTRUCTION AND MAINTENANCE OF A PET HOSPITAL. THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALI- FORNIA, DOES FIND, DETERMINE, RESOLVE AND RECOMMEND AS FOLLOWS: SECTION I. That there was filed with this Commission on the 30th day of April, 1958, the application of Reuben V. Senior and Fanny L. Senior, as owners, for a special use permit for the con- struction and maintenance of a pet hospital on the following de- . scribed property in the City of Arcadia, County of Los Angeles, State of California, to wit: The west 75 feet of the east 135 feet, except for strl~ets, of Lot 68, Santa Anita Colony as shown on map recorded in Book 42, page ~7, of Misclellaneous Records of Los Angeles County, located at 108 West Las Tunas Drive. That after notice required by law, a public hearing was duly held upon the matter by and before this Commission on the 13th day of May, 1958, at which time all per- sons were given full opportunity to be heard and to present evidence. SECTION 2. That there were no protests, either oral or written, to the granting of the petition. That 100% of the owners of property with~n 300 feet of subject property signed the applica- tion as favoring the granting of the special use permit. SECTION 3. That the operation of a pet hospital is a spe- . cial use permissible in a C-2 zone. Under the present plans of con- struction the proposed building will be an improvement of an area long a problem; and its use as a pet hospital under the conditions hereinafter set forth will not be detrimental or injurious to pub- lic health or welfare nor injurious to the property or improvements , -1- 293 .I . . . It . in the vicinity in ,~hich the subject property is located. That the special use permit, as hereinafter reco~nended, is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same vicinity and zone, in that other properties in the same vicinity and zone have been granted relief by way of variance for reasons equally applicable to subject property; that the intended use of subject property is exceptional and does not apply to any other property in the same vicinity and zone. SECTION l~. That for the foregoing reasons, this Commis- sion recommends to the City Council that a special use permit for the construction and maintenance of a pet hospital be granted upon the following conditions: a. No b~ilding shall be over two and one-half stories in height. b. The exterior walls of all buildings, other than brick or natural field materials, shall be of pastel colors. c. All exterior walls shall be of masonry construction and all constructi,on shall comply with the requirements for build- ings and occupancies in Fire Zone 1. d. Thel~e shall be no windows except in the reception room and the apar~ment at the rear. e. No signs shall project above the roof line, and the total area of all signs shall not exceed one square foot for each lineal foot of building frontage on the street side. There shall be no blinking lights or moving parts on any sign. f. There shall be no outside runs or pens, and all opera- tions conducted on the premises in connection with the business here- by authorized shall be carried on within an enclosed building. g. All buildings shall be completely sound-controlled air-conditioned. -2- 293 . . . . . h. All specifications for the sound-control and air- conditioning and all plans for the parking areas, landscaping and exterior design of buildings shall be first approved by the Plan- ning Commission. i. All flood-lighting shall be directed away from adjoin- ing properties. j. There shall be a ten-foot setback from all street property lines, and such setback areas shall be landscaped and main- tained free of weeds and debris. k. Not ever fifty percent (50%) of the land area of the property shall be covered by buildings. 1. CurbEi, gutters, and sidewalks of a five-foot minimum width shall be conatructed along all adjacent streets the full length of the property pr~or to or concurrent with the erection or improve- ment of any structure on the premises. m. The plot plan submitted with the application for the special use permit must be complied with as to all details shown thereon. n. The Planning Commission may modify any of the fore- going conditions if such modification will not adversely affect property or improvements in the vicinity and if such modification will equally acco~plish substantially the same results as will the adherence to the foregoing conditions. o. The violation of anyone or more of the conditions hereinabove set fClrth shall be grounds for the revocation of said special use permit. SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
