RESOLUTION NO. 290
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE GRANTING
OF A ZONE VARIANCE TO PERMIT THE
CONSTRUCTION OF AN ADDITIONAL DWELLING
AT 535 WEST LEMON AVENUE.
WHEREAS, there was filed with this Cow~issi.n on April 2,
1958, the application of Richard M. and Norma G. Canzoneri, as own-
ers, for a zone variance to permit the erection of one additional
dwelling on the rear portion of the following described property in
the City of Arcadia, County of Los Angeles, State of California,
to wit:

The west 71.41 feet of the south 234.33 feet
of Lot 48, Tract No. 4869, per map recorded
in Book 52, page 13, of Maps, records of said
County,
located at 535 West Lemon Avenue; and,
WHEREAS, after notice required by Ordinance No. 760 of
said City, as amended, a public hearing was duly held on the matter
by and before this Commission on the 22nd day of April, 1958, which
hearing was duly continued to May 13, 1958, at each of which times
all interested persons were given a full opportunity to be heard
and to present evidence;
NOW, THEREFORE, THE CITY PLANNING CO!'l[]'-1ISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That there were no protests, either oral or

written to the granting of the variance; that many of the immediate
neighbors in writing approved the granting of the petition and sev-
eral spoke in favor of it.
SECTION 2. That subject property was purchased in r~y of
1957 with the intention of constructing an additional dwelling there-
immediate future; that three months later on August 20,

. 1957, Ordinance No. 990 was adopted which precluded construction
of the additional dwelling thereon. That the foregoing constitutes
an exceptional circumstance applicable to subject property and the
intended use thereof that does not apply generally to the property
in the same zone or vicinity.
SECTION 3. That subject property contains 16,733 square
feet with a depth of 234.56 feet; that properties to the rear of
subject property have already been resubdivided into lots of standard
width and of more than the required area and there is no practical
means of resubdividing subject property so as to permit the con-
struction of additional dwellings thereon. That thirteen lots on
the same side of the street within the same block as subject prop-
. erty have been developed to two or more dwellings; that the two lots
adjacent to subject property on the west have been improved with
more than one dwelling; that lots directly across the street from
subject property have been improved with more than one dwelling.
That within 300 feet of subject property there are twenty lots other
than subject property, eleven of which or 55% thereof are now de-
veloped with two or more dwellings; that the requested variance is
therefore necessary for the preservation and enjoyment of substan-
tial property rights of the applicant possessed by other property
in the same vicinity and zone.
SECTION 4. That the granting of the variance as herein-
after recommended will not be materially detrimental to the public

welfare or injurious to the property or improvements in the same
vicinity and zone and will not adversely affect the comprehensive
general plan.
SECTION 5. That for the foregoing reasons, this Commission
recommends to the City Council that the requested variance be granted

to permit the erection of an additional dwelling upon the condition
that the additional dwelling contain at least IOOO square feet of
floor area as is required for dwellings in Zone R-l; that said addi-
tional dwelling comply with all other regulations applicable to
dwellings in Zone R-l, and comply substantially with the plot plan,
plans and elevations submitted with the application; and that a
solid masonry wall, at least five feet in height, be maintained
across the rear property line; provided, however, that the continued
maintenance of the existing solid masonry wall on the rear property
line of the adjacent property to the rear of subject property shall
be deemed compliance with this condition.
SECTION 6. The Secretary shall certify to the adoption
of this Resolution and shall cause a copy of the same to be for-
warded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Planning Commission held on the
lOth day of June, 1958, by the following vote:
