RESOLUTION NO. 289 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A REQUESTED ZONE RECLASSIFICATION FROM ZONES C-l TO C-2, R-l TO C-2 AND R-I TO PR-3 AFFECTING CERTAIN REAL PROPERTY IN SAID CITY. WHEREAS, there was filed with this Commission on Febru- ary 27, 1958, the application of Ralph D. Stogsdill, as owner, for a zone reclassification from Zones C-l to C-2, R-l to C-2 and R-I to PR-3 of the following described real property in the State of California, County of Los Angeles, to wit: Those portions of Tract No. 6641, as shown on map recorded in Book 126, page 67, of Maps, Records of Los Angeles County, described as follows: . Lots 23, 24 and 25, to be changed from Zone C-l to Zone C-2~ Lot 26, to be changed from Zone R-l to Zone C-2 . Lot 27, to be changed from Zone R-l to Zone PR-3, located respectively at the southeast corner of Las Tunas Drive and Baldwin Avenue, 554 I-lest Las Tunas Drive and just east of 554 West Las Tunas Drive; and, WHEREAS, after notice required by Ordinance No. 760 of . said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 25th day of March, 1958, which said hearing, at the request of the attorney for the applicant, was continued to April 22, 1958, and still further continued to May 13. 1958, at which times all interested persons were given a full oppor- tunity to be heard and present evidence; NOW, THEREFORE,THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: -1- 289 t,.. _ . . ., . . SECTION 1. That in addition to numerous oral protests, . the owners of more than one hundred parcels in the general neigh- borhood filed written protests to the requested rezoning on the . . grounds that the proposed commercial uses in a residential neigh- borhood would create noise and parking problems and would reduce residential property values. SECTION 2. That although the applicant, through his attorney, requested a continuation of the hearing set for March 25, 1958, for the purpose of amending his application, no amendment was filed in time for notices to be circulated for the hearing date of April 22, 1958. SECTION 3. That although Las Tunas Drive west of Baldwin Avenue is in county territory, such adjacent county territory should be given proper consideration when considering the rezoning of the subject property. That Las Tunas Drive in the Temple City area is zoned C-3 tapering down to C-2 west of Baldwin Avenue, C-I east of Baldwin Avenue in the City of Arcadia and then into a residential zone. That a variance for certain uses then permissible in Zone C-2 and (other than used car sales area) now permissible in Zone C-l which was thereafter created, was granted by Resolution No. 2319 in 1952 with respect to a portion of subject property at the south- east corner of Las Tunas Drive and Baldwin Avenue. That a variance for certain uses then permissible in Zone C-2 and now permissible in Zone C-I, which was thereafter created, was granted by the City Council by Resolution No. 2550 in 1954 with respect to a portion of subject property; that each of said variances has expired by reason of non-user. That in 1955, Lots 23, 24 and 25 were rezoned to C-l, and to date the only C-l use thereof has been the construction of a restaurant on Lot 25. That the granting of C-2 uses on Las Tunas , Avenue could reasonably cause further requests Drive east of Baldwin for additional commercial zoning or some transitional use further into the existing residential zone. -2- 289 I .. . .. . . . SECTION 4. That no exceptional or extraordinary circum- stances were shown applicable to subject property; that no need for C-2 zoning on this particular oorner was shown; that it does not appear that public necessity, convenience, general welfare and good zoning practice justify the requested zone change, but rather that the requested change would be detrimental to the residential prop- erty in the area. SECTION 5. That for the foregoing reasons, this Commis- sion recommends to the City Council that the request of Ralph D. Stogsdill for a change of zone be denied. SECTION 6. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City . Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commission held on the 27th day of May ,1958, by the following vote: AYES: Commissioners Acker, Forman, Pratt and Robertson NOES: None ABSENT: Commissioners Davison, Michler and Vachon Chairman Pro tempore .
