RESOLUTION NO. 288 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A REQUESTED ZONE RECLASSIFICATION FRO~1 ZONE R-l TO ZONE R-3 AFFECTING CERTAIN REAL PROPERTY IN SAID CITY. WHEREAS, there was filed with this Commission on January 17, 1958, the application of Herbert W. Ambs and others, as owners, for a zone reclassification from Zone R-I to Zone R-3 of the follow- ing described real property in the State of California, County of . Los Angeles, to wit: Lots 3 to 6 inclusive; the west 50 feet of Lot 15; Lots 16 to 20 inclusive; Lots 27, 28 and 29; Lots 36 to 43 inclusive, Tract No. 6641 as shown on map recorded in Book 126, page 67, of Maps, Records of said County, located in the general vicinity of Baldwin Avenue and Las Tunas Drive, extending east approximately 600 feet from Baldwin Avenue; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly noticed on the mat- ter by and before this Commission for the 25th day of March, 1958, which said hearing, at the request of the applicant, was continued to April 22, 1958, and still further continued to May 13, 1958, at each of which times all interested persons were given a full oppor- tunity to be heard and present evidence; . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: -l- 288 .' ,.~~,.. . . . SECTION 1. That in addition to many oral protests, pro- tests to such rezoning were filed by the owners of more than one hundred parcels in the general neighborhood, on the grounds that the proposed use of apartment houses would create noise and park- ing problems in a quiet single famdly residential neighborhood, and would reduce property values. . SECTION 2. That although the applicant requested a con- tinuation of the hearing set for March 25, 1958, for the purpose of filing an amended application, no amendment was filed in time for notices to be circulated for the hearing date of April 22, 1958. That the petition filed requesting that a portion of the original area be excluded from the application was not signed by the owners of all the property for which exclusion was requested. SECTION 3. That the petition, as originally filed, re- quested rezoning on only one side of Woodruff Avenue and Workman Avenue, leaving R-l zoning at the southwest corner of Woodruff Ave- nue and Baldwin Avellue with the probability of further applications for zoning relief; that even with the requested exclusion of some areas, the petition still proposed R-3 zoning on the north side of Las Tunas Drive across the street from ZonES C-l and R-l, resulting in an island of R-3 zoning on Baldwin Avenue without regard to other properties. SECTION 4. That no exceptional or extraordinary circum- stances were shown applicable to the property; that it does not ~ appear that public necessity, convenience, general welfare or good zoning practice justify the requested zone change, but rather that the request is premature and not in the interest of good planning and would be detrimental to the residential property in the neigh- borhood. -2- 288 r . ...... . . . . . SECTION 5. That for the foregoing reasons, this Commis- sion recommends to the City Counc.il that the request of Herbert W. Ambs and others, for a change of zone be denied. SECTION 6. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commission held on the 27th day of May , 1958, by the following vote: AYES: Commissioners Acker, Forman, Pratt and Robertson NOES: None .
