RESOLUTION NO. 285 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL, WITHOUT PREJUDICE, OF A ZONE VARIANCE TO PERMIT THE REAR PORTION OF PROPERTY AT 140 EAST DUARTE ROAD TO BE USED FOR AUTOMOBILE PARKING PURPOSES. WHEREAS, there was filed with this Commission on the 21st day of March, 1958, the application of the Arcadia Masonic Temple, Association, Inc. as owner, signed by Elmer E. Westerhouse, Presi- dent, for a zone variance to permit the use for automobile parking . purposes of the following described property in the City of Arcadia, County of Los Angeles, State of California, to wit: Part of Lot 14, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, records of Los Angeles County, described as follows: Beginning at a point in the north line of said lot 108.5 feet west from the northeast corner hereof; thence south to a point in the south line of said lot 107.23 feet west from the southeast corner thereof; thence west on said south line 107.23 feet; thence north to a point in the north line of said lot 217 feet west from the northeast corner thereof; thence east 108.5 feet to the point of beginning, located at 140 East Duarte Road; and, WHEREAS, after notice as required by Ordinance No. 760 of said city, as amended, a public hearing was duly held on the matter by and before this Commission on the 18th day of April, 1958, which said hearing was duly continued to April 22, 1958, at each of which times all interested persons were given a full opportunity to be . hearoand to present evidence. NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: -1- 285 i/ J , ~ . . . . . . SECTION 1. That there were protests both oral and written to the granting of the requested variance for the reason that an automobile parking area adjacent to R-l property, without proper re- strictions as to a buffer zone, would be injurious to residential property and improvements in the vicinity. SECTION 2. That the proposed use of the north half of the above described property, fronting on Duarte Road and zoned C-l, is for the erection of the new Masonic Temple. That subject property is a long narrow lot approximately 107 feet by 450 feet. That the parking requirements for the proposed Masonic Temple in a C-l zone would necessitate the use of most of the rear half of subject prop- erty. SECTION 3. That at the time Greenfield Avenue was devel- oped in Tract No. 19712, the planned development of the area was to extend Greenfield Avenue northerly to a cross street, and to provide a buffer zone of R-2 lots between the northerly side of such cross street and the southerly side of the commercial lots facing Duarte Road, so as to provide a reasonable transition between the R-I resi- dential and the cOrrIDlercial properties. That the granting of the re- quested variance would prevent this planned extension of Greenfield Avenue and would establish a precedent for requests for other vari- ances in the immediate vicinity. SECTION 4. That it was not shown that the variance as re- quested is necessary for the preservation or enjoyment of a substan- tial property right of the applicant possessed by other property in the same zone or vicinity. SECTION 5. That for the foregoing reasons, this Commission recommends to the City Council that the application of the Arcadia Masonic Temple Association, Inc. for a zone variance be denied with- out prejudice to a reapplication, and that the applicant work with -2- 285 ....... ,. . . 4It the City staff to formulate a plan establishing a suitable buffer between the parking area and the residential area. SECTION 6. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commission held on the 13th day of Ms.y , 1958, by the following vote: AYES: Commissioners Acker, Davison, Forman, Michler, Robertson and Vachon NOES: ;.lone .
