RESOLUTION NO. :~'7i:; A RESOLUTION OF THE CITY PLANNING COMlIlISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECO~mENDING THE GRANTING OF A VARIANCE TO PERMIT AN ADDITION AT THE REAR OF AN EXISTING PROFESSIONAL OFFICE BUILDING, THE ESTABLISHr~~T AND OPERATION OF A PHARMACY THEREIN, AND THE ERECTION A1\jD MAINTENANCE OF A SIGN AT 600 VffiST HUNTINGTON BOULEVARD. \iHEREAS, there was filed with this Commission on the 20th day of January, 1958, the application of the Arcadia Professional Center, signed by Ralph T. Merriam, President, for a zone variance to allow an addition at the rear of the existing professional office building to be used for additional medical offices, for the establish- ment of a prescription pharmacy therein, and for approval of a sign four feet seven inches by six feet, mounted on a post approximately ... fifteen feet high, to be located at the front property line on prop- erty in the City of Arcadia, County of Los Angeles, state of Califor- nia, described as Lot 13, Tract No. 2828, as shown on map recorded in Book 33, page 63, of Maps, records of Los Angeles County; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the lIth day of February, 1958, l'lhich said hearing was duly continued to February 25, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING Cor.uUSSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: . SECTION 1. That there were no protests to the granting of the variance. That Lots 12, 13 and 14 of said Tract No. 2828 are and for some time have been under common ownership, and all three lots are zonecrR-3. That the first unit of tne medical buildings was con- structed on Lot 14 to the east of subject property at a time when medical buildings were a permissible use in the R-3 Zone; that the '. -1- (, P" -,' _, t I., II -, ~. "I r .J ~."{b 1''''''' ' .J / . . . . . second unit of the medical building was constructed on subject prop- erty under the terms of a variance granted by the City Council by Resolution No. 2604 adopted on June 21, 1955. SECTION 2. That the proposed additional medical offices are silnilar to those now existing on the subject property, and both the existing buildings and the proposed addition thereto conform to the present provisions of the C-~ Zone; that until the adoption of Ordinance No. 900, subject property could lawfully be used for the construction, mailltenance and operation of a medical office; that the applicant is the owner of properties adjacent to subject prop- erty, all of which properties were acquired for the purpose and planned for the full utilization thereof as a medical office center. That a large part of this plan had been completed prior to the adop- tion of Ordinance No. 900, removing medical offices from the list of uses permissible in Zone R-3. That pharmacy is now recognized as a profession. That the doctors already lawfully occupying the premises may, both under state and local law, compound prescriptions for their patients; that such compounding of prescriptions can be more effi- Ciently conducted at one location by a registered pharmacist than can be done individually by the several doctors using the premises. That a central prescription pharmacy could be of great convenience to doctors and patients alike. SECTION 3. That the granting of a variance to allow the constl~ction and use of additional medical offices upon the property and to allow the construction and operation of a prescription phar- macy handling only medicinal and home sickroom supplies and prescrip- tions, and surgical and post operative supplies and appliances, upon the conditions hereinafter recommended will not be inconsistent with good planning practice nor wi~h the provisions of the master zoning plan, nor with the present or prospective development of the neigh- borhood in which the property is located, but rather will be in -2- ~IU j -'", '1.".. . . . . . ~onformity with each of the foregoing. That the granting of such a variance will not adversely affect the comprehensive general plan nor' will it be materially detrimental to property or improvements in the vicinity or zone in which the property is located. That the granting of such a variance is necessary for the preservation of sub- stantial property rights of the applicant. SECTION l~. That for the foregoing reasons, this Comnission recommends that a variance be granted to permit the above described property to be used for the construction of an addition to the rear or the existing professional office building on subject property to be used for additional medical offices and for the establishment and conduct of a prescription pharmacy upon the following terms and conditions: a. That subject property shall be used only for those uses permitted in Subsections d, e, f, i, j, k, I and n of Section 8.1-A-2 of Ordinance No. 760 as amended by Ordinance No. 900, or Subsections d, e, f, h, i, j, k, and 1 of Section 8.1-A-2 of Ordinance No. '(00 as amended by Ordinance No. 1001; b. That the prescription pharmacy handle only medicinal and home sickroom supplies and prescriptions, and surgical and post operative supplies; that the sale of candy, papers, magazines, tobac- co and all other sundries be prohibited; c. That the prescription pharmacy be conducted within the area designated on the plot plan submitted by applicant; that said area be neither changed nor enlarged. SECTION 5. That by reason of the deep building setback line applicable to subject property, and the fact that subject prop- erty abuts a one-way street, the public convenience will be best served by pernutting an identification sign of the size and type and at the location hereinafter recorrunended; that the gr'anting of a -3- 278 ~... ", .. . . . variance for such sign will n0t be inconsistent with good planning practice nor with the provisions of the master zone plan, nor with the present or prospective development of the neighborhood in which the property is located, but rather in conformity with each of the foregoing. That the granting of such a variance will not adversely affect the comprehensive general plan nor will it be materially detrimental to property or improvements in the vicinity or zone in which the property is located. SECTION 6. That for the foregoing reasons this Commission recommends that a variance be granted to permit the construction and maintenance of an identification sign upon subject property at the location and in accordance with the design, size, shape and method of construction to be approved by the Modification Committee of the . Planning Commission. SECTION 7. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
