RESOLUTION NO. 275 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT THE CONSTRUCTION AND MAINTENANCE OF APART- MENTS OVER A PROPOSED MORTUARY AT 611 WEST DUARTE ROAD. WHEREAS, there was filed with this Commission on the 23rd . day of December, 1957, the application of Johanna M. Wenz, as owner, for a zone variance to permit the construction and maintenance of apartments over a proposed mortuary for which a variance and special use permit was granted by Resolution No. 2887 adopted by the City Council of the City of Arcadia on May 21, 1957, on the following de- scribed property in the City of Arcadia, County of Los Angeles, State of California, to wit: Lot 44, Tract No. 3430, as shown on map recorded in Book 42, page 32, of Maps, records of Los Angeles County, located at 611 West Duarte Road; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 14th day of January, 1958, which said hearing was duly continued to January 28, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That there were protests to the granting of the . variance; that said protests, however, were against the erection of a mortuary, itself, at said location for which a variance and special use permit already have been allowed by aforesaid council resolution, rather than against the construction of apartments above the mortuary. -1- 275 ./ . ~ ...- . . . . . SECTION 2. That the construction of living quarters is essential to the conduct of the mortuary business; that although the proposed addition provides a two-story portion of the building, the exterior elevation is substantially in compliance with the original plan submitted and approved by the previous resolution; that if the original dwelling on the property were remodeled to conform to the architectural design of the building to be erected, the requested change would comply with the intent of the previous variance granted. SECTION 3. That the need of living quarters in connection with a mortuary constitutes an exceptional circumstance applicable to the intended use of subject property that does not apply generally to property in the same vicinity. That the granting of the variance upon the conditions hereinafter recommended will not be detrimental to the public health or welfare or injurious to the property or im- provements in such zone or vicinity in which property is located. That the variance as hereinafter recommended will not adversely af- fect the comprehensive general plan and that the requested variance is reasonably necessary for the preservation and enjoyment of a sub- stantial property right of the applicant. SECTION 4. That for the foregoing reasons this Commission recommends that a variance be granted to allow the construction and occupation of apartments over the proposed mortuary; that the final plans of the mortuary as submitted by applicant be approved subject to the applicant's submitting a letter stating her intent to remodel the existing dwelling to conform in architectural appearance with the mortuary; and that plans of the remodeling of the existing dwelling be submitted for approval by the Planning Commission before final inspection is given on the mortuary building; that the remodeling of the existing dwelling be completed within six (6) months after completion of the mortuary construction; and that the special use the construction, maintenance and operation of a mortuary -2- 275 ~ . ...... . . . as heretofore granted by aforesaid Resolution No. 2887 of the City Council be amended to the extent required by the provisions hereof. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
