A RESOLUTION OF THE CITY PLANNING COMr~ISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT THE ERECTION OF APARTMENT HOUSES ON LAS TUNAS DRIVE. WHEREAS, there was filed with this Commission on Octo- ber 24, 1957, the application of Ross A' Himes and June Nancy Himes, as owners, for a zone variance to permit the followlnB de- scribed property in the City of Arcadia, County of Los Angeles, State of Califo~nia, to wit: A portion of Lot 66, Santa Anita Colony, as shown on map recorded in Book 42, page 87, Miscellaneous Records of Los Angeles County, described as follows: Beginning at a point in the north line of said lot, distant North 89059'30" West 550 feet from the northeast corner of said lot; thence South 0000115" west 177.50 feet; thence North 89059'30" West 315 feet, more or less, to a line parallel with and distant 210 feet east- erly from the west line of said lot; thence South 0000'08" West to the north line of Las Tunas Drive; thence northwesterly along the north line of Las Tunas Drive to the west line of said lot 66; thence North 0000'08" East along said west line 412.50 feet to the northwest corner of said lot; thence South 89059'30" East 525 feet to the point of be- ginning, located on the south side of Las Tunas Drive, between Santa Anita and Sandra AvenQes, to be used for the erection of three 3-story apartment houses with basement parking; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter . by and before this Commission on the 12th day of November, 1957, which said hearing was duly continued to November 26, 1957, and . again continued to December 10, 1957, at each of which times all interested persons were given a full opportunj.ty to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- AND RESOLVES AS FOLLOWS: . . -1- 271 v . . . '. . . SECTION 1. That there were many protests, both oral and written, to the granting of the requested variance, emanating largely from the owners of property on Sandra Avenue and Woodruff Avenue and based principally upon the ground that the contemplated development under the requested variance would devaluate the prop- erties on Woodruff and Sandra Avenues and would deprive these per- sons of all privacy in the enjoyment of particularly the rear por- tions of their properties; that this objection is heightened by the relatively shallow depth of the adjacent lots and the requested height of the apartments to be built upon subject property. SECTION 2. That the present zoning on the subject prop- erty was intended to give the owner the highest and best use of the property and still afford a maximum of protection to the adjacent single family residences. That any changes in or variances from such basic zoning should accomplish the same purposes. That the granting of a varianc€ upon the terms and conditions hereinafter p~ovided will permit even greater use of the subject property than the present basic zoning and will afford reasonable protection to the adjacent properties. SECTION 3. That subject property is unaer one ownership and is many times larger than other properties under one ownerShip in the immediate vicinity. That the full use and development of the property under one ownership and a common plan and design will afford advantages to adjacent properties not possible if the prop- erty were divided into separate parcels based on the present zoning applicable thereto. That the foregoing constitutes an exceptional circumstance applicable to the subject property that does not apply generally to property in the same vicinity. That the granting of the variance upon the conditions hereinafter recommended will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. That the variance as hereinafter recommended -2- 271 . . . ~ . . will not adversely affect the comprehensive general plan and that the requested variance is reasonably necessary for the preservation and enjoyment of a substantial property right of the applicant. SECTION 4. That for the foregoing reasons this Commis- sion recommends that a variance be granted for the use of the prop- erty hereinabove described for the erection of apartments on the above-described property upon the following conditions: 1. The apartment buildings shall net exceed either two (2) stories or thirty (30) feet in height above curb grade. 2. The front yard on Las Tunas Drive and on Sandra Ave- nue at the cul-de-sac shall not be less than ten (10) feet. 3. A solid masonry wall six (6) feet high shall be erected and maintained along the east side of the proposed Himes Place and the south side of Sandra Avenue east of the proposed Himes Place, except that such wall shall not exceed three feet six inches (3'6") in height from Las Tunas Drive to a point twenty-five (25) feet north. 4. A strip of land five (5) feet wide on the east and south sides of the masonry wall shall be landscaped and main- tained. 5. Sandra Avenue and the proposed Himes Place shall be dedicated and fully improved as provided in the subdivision ordinance. 6. As the purpose of this resolution is to accomplish the full and uniform development of the property, no portion of the apartment house buildings, which would be permissible solely by reason of the variance hereby granted, shall be constructed unless all apartment house buildings be con- structed in accordance with the restrictions and conditions of the var'iance hereby recommended. SECTION 5. The Secretary shall certify to the adoption -3- 271 , . . . . of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
