RESOLUTION NO. 266 A RESOLUTION OF THE CITY PLANNING CO~ll~ISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECO!']f.1ENDHra THE DENIAL OF A ZONE VARIANCE TO PER;.rrT T'-IE OPERATION OF A VETERINARY CLINIC AT 727 rlEST DUfu~TE ROAD. ~'.'HEREAS, there WaS filed with this Commission on the 27th day of August, 1957, the application of Arcadia Parking, Inc., as owner, signed by James L. !,lurray as Vice President and Fern L. Griffin as Secretary, for a zone variance to permit the followinb described property in the City of Arcadia, County of Los Angeles, State of . California, to wit: A portion of Lot 124, Tract No, 2731, as shovm on map recorded in Book 33, page 29, of 1.~ps, records of said County, located at 727 ~est Duarte Road, to be used for the purpose of a veterinary clinic off1ce; and, \'THEREAS, after notice required by Ordinance No. 7:;0, as amended, of said City, a public hearing was duly held on the matter by and before this Commission on the 10th day of September, 1957, which s5id hearing was duly continued to October :.., 1957, at each of which times all interested persons ~ere given a full opportunity to be heard and to present evidence; NOW, THEREFORE, TflE CITY PLANNING COr~ISSION HEREBY DETER- JUNES AND RESOLVES AS FOLLOlVS: SECTION I. That there were many protests, both oral and \\Titten, to the granting of the requested variance, for the reason . that the intended use as proposed and ~ithout adequate restrictions would create loud noises and offensive smells and.'lOuld therefore he injurious to the property and improvements in the vicinity in ~hich the property is located. SECTION 2. That it was not shown that there are exceptional -1- , " 2':'0 t. ~ ~ '"' . . Ie or extraordin~r~" circumstances or conditions applicable to the pro- perty involved or to the intended use of the property that do not apply generally to the property or class of use in the same zone or' vicinity. SECTION 3. That it ~aB not shown that the variance is necessary for the preservation or enjoyment of a substantial pro- perty right of the applicant possessed by other property in the same zone or vicinity. That this Planning Co~nission has previously recom- mended and the City Council has heretofore determined that the use of property for a pet clinic is a use properly conJucted in an M-l Zone, That subject property is in an area near the intersection of t~o major thoroughfares and all the property abutting such thorouGh- . fares in the illDllediate vicinity of such intersection, includinG SUbject prope~ty, is classified in Zone C-2. That other properties thus classified C-2 in this vic:inity have been \~ell developed to and con- sistently used for permissible C-2 purposes. ?Jrthermore, subject property abuts property to the north zoned for, developed to, and used for multiple family purposes, and the intended use of sulljC?ct such property is not compatible with the development and use o~'''djaceDt propertiea. SECTlOi'! 4.
