RESOLUTION NO. 253 A RESOLUTION OF THE CITY PLANNING COflMISSION OF THe CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE FOR A DAY NURSERY AT 530 WEST LAS TUNAS DRIVE IN SAID CITY. . WHEREAS, there was filed with this Commission on March 13, 1957, the application of Dorothy Lo Guidice, as owner, for a zone variance to permit the following described property in the County of Los Angeles, State of California, to wit: Lot 28, Tract No. 6641, as shown on map recorded in Book 126, page 67, of Maps, Records of Los Angeles County, located at 530 West Las Tunas Drive, to continue to be used as a Children's day nursery for not over thirty-five cfiildren and to make such variance permanent; and, WHEREAS, after notice required by Ordinance No. 760, as amended, of said City, a public hearing was duly held on the matter by and before this COmmission on April 9, 1957, which hearing was duly continued to April 23, 1957, at which times all interested per- sons were given a full opportunity to be heard and to present evi- dencej NOW, THEREFORE, THE CITY PLANNING COI'IMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION I. That there was only one written protest against the granting of the variance and no one appeared to orally rrotest it; that one resident in the neighborhood spoke in favor of the vari- . ance; that there has been a variance for the requested purpose on subject property since 1950, with little or no complaint from SUI'- roundtng residents. That there have been few chanees in the facts and Circumstances as found to exist on March 25, 1952, as determined ~ by this Conunission under its Resolution No. 03. SECTION 2. That the property involved is located on a . /' -1- 2;;.3 , . . o :... . . busy thoroughfare; the adjoining property on the west is unimproved and is not likely to be improved in the near future under the require- ments of Zone R-l in which it is located; tllat these circumstances do not apply generally to property in the same zone, but do apply to properties similarly situated on Las T11nas Drive. That such vari- ance is necessary for the preservation and en:oyment of substantial property rights of the applicant. That the granting of the variance ~ hereinafter recommended will !lot be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. SECTION 3. That subject property was improved for and is still llsable as a Single family residence; that all properties within the block east of subject property on both sides of the street are developed for and used solely as single family residences. That most improvements wit~n the same block but west of subject property have been of a commercial type. That the granting of a permanent variance at this time, as requested by applicant, would be premature, but should await the fUl'!ti1er development of other proPerties within the block west of subject property. SECTION 4. That the granting of the variance for the period hereinafter recommended will not be inconsistent with Good planning practice or the provisions of the master zonin8 plan, or with the present development of the neiGhborhood in which said prop- erty is located, nor will the granting of the variance as hereinafter rec~nmended adversely affect the comprehensive general plan. SECTION 5. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance be granted to permit the operation of a children's day nursery for not over twenty pupils at 530 West Las Tunas Drive for a period of five years, on the property hereinabove described. SECTION 6. The Secreta~J shall certify to the adortion Resolution and shall cause a copy to be forwarded to the -2- 253 -'- ...' . . . City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commtssion held on the 14th day of Nay , 1957, by the following vote: AYES: Commissioners Balser, Dal:y, Davison, Robertson and Vachon NOES: None ABSENT: Comnlissioners Acker and Pratt fJfIii < ~ .
