A RESOLUTION OF TliE CITY PLANNING
CO~USSION OF THE CITY OF ARCADIA,
CALIFORNIA, :RECOMMENDING THE GRANTING
OF A VARIANCE AND SPECIAL USE PERMIT
FOR THE CONSTRUCTION AND OPERATION OF
A MORTUARY AT 611 WEST DUARTE ROAD.
WHEREAS, there was filed with this Commission on the 16th
of January, 1957, the petition of Johanna M. Wenz, as owner, for a
zone variance and special use permit to allow the following de-
scribed property in the City ~ Arcadia, County of Los Angeles,
State of California, to wit:
Lot 44, Tract No. 3430, as shown on map re-
corded in Book 42, page 32, of Maps, records
of Los Angeles County,
located at 611 West Duarte Road, to be used for the construction
~ and operation of a mortuary; and,
WHEREAS, after notice required by Ordinance No. 760, as
amended, of said City, a publiC hearing was duly held on the matter
by and before this Commission on the 13th day of February, 1957,
which hearing was duly continued to February 26, 1957, at which
times all interested persons were given a full opportunity to be
heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION I. That there were numerous protests, both oral
and special use permit
and written, to the granting of said variancejbecause it would de-
crease real estate values in that vicinity.

SECTION 2. That although subject property is in Zone R-I,
the lots to the north, facing on Fairview, are zoned R-3; that with
the exception of Lot 43, adjacent on the west, the balance of the
lots west of subject property on both sides of Duarte Road are
zoned either C-2 or 0-3; that variances have been granted in the
past for property in the vicinity;and that subject property is such
a large lot that it is now more suitable for' the purpose requested

than for R-I uses.
SECTION 3. That by Section 17 of Ordinance No. 760, as
amended, mortuaries are declared to be a use possessing character-
istics of unique and special form as to make ~~practical their
being automatically included in any clsss of use as set forth in
the various zones. That the use of property for a mortuary is per-
missible in any zone upon the granting of a special use perndt
therefoI:'. That a mortuary is a business of personal service, the
amount of which a cOlJUnunity requires is determined by the size and
population of the community and other factors in the co~~unity af-
fecting the need for mortuaries; that the hearing concerning the
subject property, as well as the hearing of applicant's preVious
application concernJlIg other property, demonstrated rather clearly
the need for additional mortuary service within the community.
SECTION 4. That the use of propert;y for churches, mortu-
aries, clubs, lodge halls and medical offices makes an effective
buffer or transition from a residential area to a commercial area;
that the use of subject property for a mortuary could serve to
limit the encroachment of commercial development in residential
areas along Dllarte Road east from Baldwin Avenue.
SECTION 5. That the public welfare and convenienCe rea-
sonably require the req\lested variance and special use permit and
that, upon the conditions recommended, the granting of such a vari-
ance and special use permit will not be inconsistent with good
planning practice, nor with the provisions of the master zoning
plan, nor with the present or prospective development of the neigh-
borhood in wt1ich the property is located. That there is an ex-
ceptional condition applicable to the intended use of the property
that does not apply generally to the class of use in the same zone
or vicinity; that such exceptional circumstance is recognized by the
classification of mortuaries as a special use. That Dllarte Road is
a major traffiC thoroughfare and that variances for churches, for

example, have been granted on properties abutting Duarte Road in
.. the same general area.
SECTION 6. That for the foregoing reasons, this Commis-
sion recommends to the City Council of the City of Arcadia that a
variance and special use permit be granted to permit the real prop-
erty hereinabove described to be used for the construction and
operation of a mortuary subject to the following conditions:
a. That twelve feet be dedicated for street widening
along Duarte Road;
b. That thirty feet be dedicated for future street pur-
poses at the rear of the property, with the stipulation by the own-
ers of their willil~ess to contribute their proportionate share
for the cost of improvements for street opening, if and when it
occurs;

c. That concrete block walls be constructed surrounding
the parY~ng lot wherever it abuts residential property, and also
along the driveway from the parking lot to the front building line,
consistent with the requirements for commercial property abutting
residential property;
d. That no chimes, bells, or other music be permitted

that could be heard beyond the limits of this property;
e. That the parking lot entrance and exit on the easterly
side of the property be increased to twenty feet to allow two lan~
traffic, rather than t~e proposed twelve feet;
f. That the parking lot plan be redes1gned to provide
greater maneuverability within the lot so that processions can be
formed vdthin the property rather than on the streets;
g. That there be substantial compliance with the plot
plan and architectural render1ng stlbmitted.
h. That each of the foregoing conditions shall be
material and shall be complied with throughout the use of
subject property as a mortuary; that the violation of anyone
e of the foregoing conditions at any time shall constitute

cause for modification or revocation of the special use ~ermit
4It hereby recommended.
SECTION 7. The Secretary shall certify to the adoption
of this Resolution and shall cause a copy of the same to be for-
warded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was
adopted at a regular meeting of the City Planning COffinlission held
on the 12th day of March, 1957, by the following vote:
AYES: Commissioners Acker, Balser, Daly, Pratt, Robert-
son and Sorenson
NOES: None
