RESOLUTION NO. 228 A RESOLUTION OF THE CITY PLANNING COM1.uSSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A REQUESTED ZONE RECLASSIFICATION FROM ZONES R-l, R-2 ~~ C-l TO ZONES C-2 AND P AFFECTING CERTAIN REAL PROPERTY IN SAID CITY. WHEREAS, there was filed with this Commission on June 28, 1956, the application of Fred M. Coxon and others, as owners, for a zone reclassification from Zones R-l, R-2 and C-l to Zones C-2 and . P of the following described real property in the State of Cali- fornia, County of Los Angeles, to wit: Lot 9 and the west half of Lot 10, Block 62, Santa Anita Tract, as shown on map recorded in Beok 16, page 58, Miscellaneous Records of Los Angeles County; and the East 104.96 feet of Lot 13; the West 113.23 feet of Lot 14; and Lot 33, except the South 80 feet of the West 120.46 feet thereof, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, in the office of said Los Angeles County Recorder, near which is located I the southeast corner of Second Avenue and Duarte Road; and, WHEREAS, after notice required by Ordinance No. 760, as amended, of said City, a public hearing was duly held on the matter by and before this Commission on the 24th day of July, 1956, which hearing was duly continued to August 14, 19~6, at which times all interested persons were given a full opportunity to be heard and to present evidence; NOVI, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: . SECTION 1. That in addition to numerous oral protests, there were written protests to the granting of the application, signed by over' eighty property owners in the vicinity, on the grounds that the property had recently been rezoned and that further rezoning would be detrimental to their residential property. That there were against any zoning that would allow the sale of alcoholic area. -1- 228 . . '. SECTION 2. That much of the subject property has been . reclassified to Zone C-l within the last year; that there has been no commercial development of the property since such rezoning; that sufficient time has not elapsed to show the need of a different zoningj that there is still much vacant C-2 property in the City of Arcadia available for such commercial development that should be used before more property is changed to general commercial use. That the rezoning of subject property in three different blocks on Duarte Road would constitute spot zoning. SECTION 3. That no exceptional or extraordinary circum- stances were shown applicable to the propertYj that it doe{l not appear that public necessity, convenience, general welfare or good zoning practice justify the requested zone change. That the granting of such a variance would be detrimental and injurious to the surround- . ing R-l property. SECTION 4. That for the foregoing reasons, this Commission recommends to the City Council that the request of Fred M. Coxon and others for a change of zone be denied. SECTION 5. The Secretary shall certify to the adop~ion of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commission held on the 28th day of August , 1956.
