RESOLUTION NO. 225

A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE GRANTING
OF A VARIANCE FOR THE CONSTRUCTION AND
CONDUCT OF A CHURCH AND SUNDAY SCHOOL
AT 512 WEST DUARTE ROAD.

WHEREAS, there was filed with this Commission on May 22,
1956, the petition of OUr Savior Lutheran Church, as owner, for a
zone variance to permit the following described property, to wit:
That portion of Lot 1, Tract No. 4090, as shown
on map recorded in Book 43, page 47, of Maps,
records of Los Angeles County, beginning at the
northeast corner of Lot 2 of said Tract No.
4090, thence south along the east line or said
Lot 2, 348.18 feet to the southeast corner of
said lot; thence east along the easterly pro-
longation of the south line of said Lot 2, 170
feet; thence north 377.09 feet to a POint in
the north line of said Lot 1; thence south 810
west 172.03 feet to the point of beginning,
located at 512 West Duarte Road, to be used for the construotion and
conduct of a church and Sunday School; and,
WHEREAS, after notice required by Ordinance No. 760 of said
City, a public hearing was duly held on the matter by and before this
Commission on the 26th day of June, 1956, which hearing was duly con-
tinued to July 10, 1956, at which times all interested persons were
given a full opportunity to be heard and to present evidence;

NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That there were numerous protests, both oral
and w~itten, to the granting of said variance because it would cause

increased traffic and would in effect result in spot zoning.
SECTION 2. That although subject property 1s in Zone R-l,

there are several ohurches and schools on Duarte Road in the imme-
d1ate vicinity inCluding one on the same side of the street within
the same block; that the real property for whioh the variance is
requested 1s a large lot more suitable for the purpose requested
than for a single residence.

SECTION 3. That the public welfare and convenience
and
. reasonably require the requested variance,;'Upon the conditions recom-
mended will not be inconsistent with good planning practice, nor with
the provisions of the master zoning plan~ nor with the present or
prospective development of the neighborhood in which the property
is located.
SECTION 4. That for the foregoing reasons, this Commis-
sion recommends to the City Council of the City of Arcadia that a
variance be granted to permit the real property hereinabove de-
scribed to be used for the construction and conduct of a church and
Sunday school to be located substantially in accordance with the
revised plot plan filed July 18, 1956, with the Secretary of the
Planning Commission, and subject to the following conditions:
a. That OUr Savior Lutheran Church execute and record an
. offer to dedicate for street and highway purposes the Easterly 30
feet of the property, excepting the southerly 100 feet thereof,
said offer to remain in force for twenty (20) years after the exer-
cise of the variance, the offer to lapse if the variance be not
used for the purpose thereby authorized within six months;
b. That a deed be tendered by the church along with the
offer, but not accepted until the remaining property required for
the opening of the future street be aoquired; that said deed may
be tendered upon the condition that the applicant for the varianoe
will not be required to pay any cost of the improvement of the
street when and if construoted on the property tendered without con-
sideration;

c. That a deed be given to the City for street and high-
way purposes for the 12-foot Widening of Duarte Road in front of
subjeot property.
SECTION 5. The Seoretary shall certify to the adoption of
this Resolution and shall cause a copy to be forwarded to the City
Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted
