A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF THE REQUESTED ZONE RECLASSIFICATION :FROM ZONE C-2 TO ZONE M-l AFFECTING CERTAIN REAL PROPERTY IN SAID CITY. WHEREAS, there was filed with this Commission on the 14th day of December, 1955, the application of Herbert Kalliwoda, as owner, for a zone reclassification from Zone C-2 to Zone M-l of the following described property in the City of Arcadia, County of Los Angeles, to wit: A portion of Lot 69, Santa Anita Colony, as shown on map recorded in Book 42, page 87, of Miscellaneous Records of Los Angeles County, described as follows: . Beginning at the intersection of the west line of said Lot 69 with the north line of Live Oak Avenue; thence North 80005'15" East along said north line 101.24 feet; thence North 0055'35" West 113.36 feet; thence South 89003'25" lofest lOO feet; thence South 0055'35" East 129.17 feet to the point of beginning, being the south portion of the property known as 82 West Las Tunas Drive; and, WHEREAS, after due notice as required by law, a publiC hearing was held in the matter by and before this Commission on January 10, 1956, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, the City Planning Commission does hereby find, determine and resolve as follows: SECTION 1. That while there were oral expreSSions in ~ favor of granting said application, there were numerous written pro- tests against the granting of an M-l zoning to any particular piece of property and to the granting of M-l'zoning at all in that area. SECTION 2. That the limited M-l use requested in the ap- plication would not be enforceable under an M-l zoning; that rezon- ing the one subject parcel would create spot zoning and would not improve an area where development had not been well handled; but -l- 210-A . , Ie . . . . . that the property under its present zoning could be developed as an asset to the City. That the reclassifioation of the subject property as requested would not assist in but rather would preclude the orderly development and utilization of subject property and of the entire area. That the requested reclassifioation is not necessary for the protection of substantial property rights for the reason that a vari- ance has been granted and exercised for five years for the use of the property beyond the uses permitted by present zoning. SECTION 3. That for the foregoing reasons, this Commis- sion reoommends to the City Council that the r.equested reclassifi- cation be denied. SECTION 4. The Secretary shall oertify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commission held on the 14th day of February, 1956.
