RESOLUTION NO. 210 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA; CALIFORNIA; RECOMMENDING DENIAL OF REQUESTED VARIANCE FOR TIRE REPAIR AND RECAPPING. . WHEREAS, there was filed with this Commission on Novem- ber 28. 1955, the petition of the Goodyear Tire and Rubber Company, Inc.. for a zone variance to permit the following desoribed prop- erty in the City of Arcadia, County of Los Angeles, to Wit: Tha'eas!; 30 feet of Lot 14 and the east 12 feet of the vacated alley adjacent on the west; and the west 57 feet of Lots 15, 16 and 17, Block 74, Santa Anita Tract" as shown on map recorded in Book 15, pages ~9 and 90, of Mis- cellaneous Reoords of said county, looated at 55 East Huntington Drive. to be used for the purpose of installing and operating equipment for repairing and recapping tires; and, WHEREAS. after notioe required by Ordinanoe No. 760 of said City, a public hearing was duly held on the matter by and be- fore this Commission on the l3th day of Deoember, 1955, at whioh time all interested persons' were given a full opportunity to be heard and to present evidenoe; NOW; THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: . SECTION I. That there were protests, both oral and writ- ten, to the granting of the requested varianoe. That the subject property is presently zoned C-2, and the granting of the requested variance is not neoessary for the preservation of substantial prop- erty rights of the applicant, for the reason that the subjeot prop- erty as well as other properties in the same vicinity and zone are presently useful for and for a long time have been used for the purposes for which they are zoned. That the granting of the re- quested variance wou;J,d, by reason of the nature of the use which would thereby be authorized, injuriously affeot adjaoent propertie~ /i' " . , : . -1- -' , 210 / .. . . and the business of tire reoapping would not be desirable in the . heart ot a business disbriot nor oOllJllatible to the uses therein. That tire recapping is a use specified as permissible in Zone M-l, and should not be permitted in more restrictive zones except for reasons muoh more oogent than an;y shown to affect the subject prop- erty. That there are no exoeptional circumstances applioable to the intended. use ofsub.1ect property and no excepUonal circum- stances applioable to the property itself as to require the grant- ing of the reqUested varianoe. ,SECTION 2. That for the .foregoing reasons, this Commis- sion recommendB to the City Council that the request of the Good- year Tire and Rubber COlIJIl~, Inc. for a varianoe be denied. SECTION 3. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be .forwarded to the . City CO\mcil of the City of Arcad.1a. I HB.REB!
