RESOLUTION NO. 204 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA1 CALIFORNIA; RECOMMENDING THE GRANTING OF A VARIANCE TO PERMIT THE CONSTRUCTION, MAINTENANCE AND OPERATION OF A MINIATURE GOLF COURSE AT 614 WEST LAS TUNAS DRIVE UPON CERTAIN SPECIFIED CONDITIONS. WHEREAS, there was filed with this Col1Dll1ssion on August 25, 1955, the petition of Ralph D. and Lula P. Stogsdill, as owners, for a zone variance to permit the following desoribed property 1 to wit: The east 120 feet of Lot 23; the east 120 feet of Lot 24; and the north 41 feet of the east 113 feet of Lot 411 Tract No. 66411 as shown on map recorded in Map Book 126, page 67, in the office of the County Reoorder of Los Angeles COuntYI . being a parcel of land on the south side of Las Tunas Drive approxi- mately ll7 feet east of Baldwin Avenuel having a frontage of 120 feet and a depth of 205 feetl to be used for the establishment and maintenance of a miniature golf oourse; and, WHEREAS, after notice required by Ordinance No. 760 of said City, a publiC hearing was duly held on the matter by and before this Commission on the 13th day of September 1 1955, at which time all interested persons were given a tull opportunity to be heard and to present evidenoe; . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the only protest was filed by a resident living more than a block away from SUbject property; that the owners of all lots on the south side of Las Tunas Drive within 300 feet of subject property, the owners of all lots on the east side of Baldwin Avenue between Las Tunas Drive and Workman Avenue and the owners of several lots on the north side of Las Tunas signed a petition filed by James F. e portion. of Lot 24. That subject property is now in Zone R-I but the Commission has already recommended by Resolution No. 201 that all exoept the portion of Lot 41 be zoned to Zone C-l; that variances have been granted in the past for the southeast corner and the northeast corner of Baldwin Avenue and Las Tunas Drive and for other property located within 300 feet to the east of subjeot property. That the southwest and northwest corners of Las Tunas Drive and Baldwin Avenue in the county are zoned C-2 and developed for commercial uses. SECTION 3. That the granting of a variance as herein- after recommended is necessary tor the preservation of substantial property rights of the applioant, and will not be inconsistent with good planning practioe, nor with the provisions of the master zoning plan, nor with the present or prospeotive development of the neigh- borhood in which the property is located. SECTION 4. That ror the foregoing reasons, this Commis- sion reoommends to the City Counoil of the City of Arcadia that a varianoe be granted to permit the East 120 feet of Lot 23; the east 120 feet of Lot 24; and the north 4l feet of the east 113 teet of Lot 41, Traot No. 6641, to be used for the oonstruotion, maintenanoe and operation of a miniature golf course upon the following express conditions: 1. That the only use authorized by reason of the varianoe hereby reoommended be the establishment, maintenance and operation of a miniature golf oourse, and shall not include any other uses oustomarily associated with or oonducted in conneotion with or incidental to a miniature golf oourse. 2. That the southerly 105 feet of Lot 25, Traot No. 6641, be improved and at all times maintained and operated as a parking lot, in aooordanoe with the provisions of Ordinance No. 760. 3. That no loudspeaker or public address system be installed on the premises or used in oonneotion with the miniature authorized by the varianoe hereby recommended. . -2- 204 . . . 4. That all exterior lights on the subject property be ~ so installed and operated that they do not shine upon or directly illuminate any adjaoent property. 5. That the oonduct or use of the miniature golf' coarse shall not be permitted between the hours of 12:00 o'olook midnight and 8:00 o'clock A.M. of any day. 6. That the possession or oonsumption of beer, wine or al~olio liquor on subject property shall be prohibited by the owner and operator of the miniature golf course on subject property, and Lot 25, Tract No. 6641, shall not be used for the sale of beer, wine or a1Cbolic liquor so long as the miniature golf course is maintained ^ or operated on subjeot property. 7. That each of the foregoing conditions shall continue throughout the entire time that the miniature golf course is main- tained or operated on subjeot property, and the violation of any of . the foregoing conditions at any time shall constitute grounds for the modification or revocation of the variance hereby reoommended. SECTION 5. The Secretary shall oertify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Counoil of the City of Arcadia.
