RESOLUTION NO. 199
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE FURTHER
DEFINING OF PRIVATE GREENHOUSES AS
USED IN SECTION 5-A-2 OF ORDINANCE
NO. 760 OF THE CITY OF ARCADIA, AND
RESCINDING RESOLUTION NO. 67
WHEREAS, by reason of ambiguity concerning the appropri-
ate classification of greenhouses, their size and looation, within
the meaning and intent of Ordinanoe No. 760 of the City of Arcadia,
which ambiguity resulted largely from the use in Section 5-A-2 of
Ordinanoe No. 760 of the term "private greenhouses" and from the
indefiniteness and uncertain meaning of suoh phrase, the City
Planning Commission did on April 29, 1952, adopt its oertain Reso-
... lution No. 67, wherein and whereby itreoommended the further
det'1nit1on of the term "greenhouses" as therein more specifioally
prOVided, which said recOl1Dllendat10n was approved and adopted by
the Arcadia City Council in its oertain Resolution No. 2245 on
June 6, 1952; and,
WHEREAS, because of the restricted size of private
greenhouses as there1n defined, undue hardship and inequity has
resulted in the application of Section 5-A-2 of Ordinanoe No. 760
as in said resolution thus clarified; and,
WHEREAS, pursuant to Section 15 of Ordinance No. 760, the
Planning Commission has further investigated the situation and
ascertained the pertinent facts as set forth in Resolution No. 67;

NOW, THEREFORE, the City Planning Commission of the City
',. of Aroadia does hereby determine and resolve as follows:
SECTION 1. That the term greenhouses as sued in Ordi-
nance No. 760 shall mean any struoturesof glass, wood, metal, cloth
or other material and designed, intended or used for the cultivation,
planting, growth, propagation or protection of plants and plant

SECTION 2. That the term "private greenhouses", as used
... in Seotion 5-A-2 of Ordinance No. 760, shall mean and be limited
to those greenhouses which are used solely by hobbyists and are
not used for any commeroial purposes.

SECTION 3. That a private lath house or greenhouse or a
combination thereof, not exceeding five hundred (500) square feet
in area may be constructed on any one lot or paroel of land.
SECTION 4. That a private lath house or greenhouse, or
a oombination thereof, in exoess of five hundred (500) square feet
in area, but in no case exoeeding fifteen hundred (1500) square
feet in area, may be construoted on one lot or parcel of land, pro-
vided that the size of such private greenhouse and lath house shall
not exoeed ten per cent (lQ%) of the vacant'rear yard of the prop-

erty on whioh they are located, measured from a point 25 feet to the
rear of the dwelling.
SECTION 5. That any such houses over five hundred (500)
square feet in area shall be subject to the approval of the Modifi-
oation Committee as to their looation on the property.
SECTION 6. That Planning Col1Dll1ssion Resolution No. 67,
approved and adopted April 29, 1952, be and the same is hereby
rescinded.
SECTION 7. That this Commission recOI1DIIend to the City
Counoil that the foregoing recommendations and interpretations be
adopted by the City Council and that the Council's certain Resolu-
tion No. 2234, adopted April 15, 1952, be resoinded.
SECTION 8. The Secretary shall. certify to the adoption
of this Resolution and shall cause a copy to be forwarded to the
City Council of the City of Aroadia.
I HEREBY CERTIFY that the foregOing Resolution was
adopted at a regular meeting of the City Planning Commission held
on the 9th day of August, 1955, by the following vote:
AYES: Commissioners Acker, Balser, Daly, Pratt,
and Vachon
