RESOLUTION NO. 198 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA; RECOMMENDING THE GRANTING OF A VARIANCE TO PERMIT THE CONSTRUCTION; MAINTENANCE AND OPERATION OF AN AUTOMOBILE SERVICE STATION AT 250 WEST COLORADO BOULEVARD. WHEREAS, there was tiled with this Collllll1ssion on June 16, 1955, the petition of Ben F. Smith, Inc., as owner, tor a zone variance to permit the property at 250 West Colorado Boulevard described as follows, to wit: A part of Lot I, Tract No. 949, as shown on map recorded in Book 17, page 13, of Maps, records ot Los Angeles County, described as follows: ~eginn1ng at the intersection of the curved southerly line of Colorado Boulevard with the northeasterly line of Colorado Place; thence easterly along said curved southerly line of Colorado Boulevard 290.04 feet; thence south 17041140" west 235.47 feet to a point in the northeasterly line of Colorado Place; thence north 30033116" west along said northeasterly line of Colorado Place 385.26 feet to the point of beginning, to be used for the construction, maintenance and operation of an automobile service station thereon; and, WHEREAS, after notice required by Ordinance No. 760 of said City, a public hearing was duly held on the matter by and before this Collllll1ssion on the 28th day of June, 1955, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, the City Planning Commission hereby deter- mines and resolves as follows: SECTION 1.. That there were no protests to the granting 01' the requested variance. That subject property is classified Zone R-3 but tor some time past, under a variance, has been used for the maintenance and operation of a restaurant; that the requested use might in some ways be more desirable than its use as a restaurant and less of a traffic hazard. SECTION 2. That the subject property consists of a I~( '1''' 198 / -1- / /- .. . . . . triangular shaped parcel of ground straddled on two sides by heavily traveled ~horoughfares; that need for relief from restric- tive provisions of the applicable R-3 zoning has for some time been recognized and the granting of a variance from the provisions of Ordinance No. 760 applicable to the property is necessary for the preservation of substantial property rights of the applicant. That the granting of the varianoe as hereinafter recommended will not be incon,sistent with good planning praotice, nor with the provisions of the master zoning plan, nor with the present or prospective development of the neighborhood in which the property is located, but ~ather in conformity with eaoh of the foregOing. SECTION 3. That for the foregoing reasons, this COl1Dllis- sion recommends to the City Council of the City of Aroadia that a varianoe be granted to permit the above desoribed property to be used for the construction, maintenance and operation of an automo- bile service station thereon upon the following conditions; 1. That a type liB" bumper fence be constructed along the southeasterly property line for a distance of thirty-five (35) feet from Colorado Place and from Colorado BouleVard; and that a oon- crete block wall four (4) feet in height be constructed along the balance of the southeasterly line of the property; 2. That the present 35-foot setback, established by ordinance, be amended to allow the construction of pump islands at a 20~foot setback instead of the l2-foot setback requested; 3. That the setback ordinance be turther amended to allow the erection of signs at the pro!'B rty line; 4. That all other variances affecting subject property be cancelled. SECTION 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Counoil of the City of Arcadia.
