RESOLUTION NO. 188 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE CLASSIFICATION OF THE STORAGE OF DRAYING EQUIPMENT AS A USE PERMISSI- BLE IN ZONE M-l UNDER ORDINANCE NO. 760 OF THE CITY OF ARCADIA WHEREAS, Section 9-A-20 of Ordinance No. 760 specifies a public garage as a use permissible in Zone C-2 under said ordi- nance; and, WHEREAS, a public garage is used among other things for the storage of motor vehicles; and, WHEREAS, Section ll-A-39 specifies storage space for transit and transportation equipment as a use permissible in Zone . M-l under said ordinance; and, WHEREAS, ambiguity has arisen by reason of the foregoing provisions concerning the use of a service station in Zone C-2 for the purpose of storing while not in use of draying equipment used in the collection of refuse or junk; and, WHEREAS, Section 15-A-l of said Ordinance No. 760 provides in part ". . .if ambiguity arises concerning the appropriate classi- fication of a particular use within the meaning and intent of this ordinance, or if ambiguity exists with reference to matters of height, yard requirements, or area requirements as set forth herein and as they may pertain to unforseen circumstances, it shall be the duty of the City Planning Commission to ascertain all pertinent facts concerning said use and by resolution of record set forth its find- , ings and the reasons therefor. . ."; and, vniEREAS, at a regular meeting this Commission has ascer- tained the pertinent facts concerning the use of property for which classification is hereinafter made; NOW, THEREFORE, the City Planning Commission of the City of Arcadia does hereby find, determine, resolve and recommend as - 1 - 188 . \ - ~ . . follows: . SECTION 1. That the storage of draying or transportation equipment is a use permissible in zone C-2 only as a use included within the business of a public garage and is not a use included generally in the uses specified as permissible in Zone C-2; that the storage of transportation equipment at a service station in Zone C.2 is not a use permissible in Zone C-2 as being incidental to the use of the premises for a service station; that the incidental use of a service station is limited to the temporary parking of transportation equipment thereat for such time as is reasonably neces- sary for the servicing of such equipment; that the storage of transit and transportation equipment, of itself, is a use specified as permissible in Zone M-l under Section 11 of Ordinance No. 760 and is not permissible in any less restrictive zone under Ordinance . No. 760 of the City of Arcadia. SECTION 2. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Planning Commission held on the 26th day of April, 1955, by the following vote: AYES: Commissioners Acker, Balser, Daly, Robertson, Sorenson and Vachcn NOES: None ABSENT: Commissioner Pratt .
