~liEREAS, there was riled with this Commission the peti-
tion of Ralph T. and Flora E. lJerriam, as owners, for a variance to
permit the followLYlg described propeL'ty, to-wit:

recorded in Book 33, page 63, of Maps, records
of Los Angeles County;

to be used for the construction, maintenance and operation of a

medical and proressional office building and prescription pharmacy
thereon; and
. V~REAS, after notice required by Ordinance No. 760 or
said City, a public hearing was duly held on the matter by and be-
fore this Commission on the 8th day of February, 1955, at Which
time all interested persons were given a full opportunity to be
heard and to present evidence;
NOW ,rHEREFOHE, the City Planning Commission hereby deter-
mines and resolves as rollows:
SECTION 1. That there were no protests to the granting
of the requested variance. That the subject property has for many
years been classified Zone R-3. 'rhA.t until the adoption of Ordi-
nance No. 900 subject pro~rty could laWfully be used for the con-
~ struction, maintenance and operation of a medical office; that the
epplicant is also tne owner of property adjacent to subject prop-
erty, all of which properties were acquired for the purpose of and
planned ror the 'full utilization thereof as a Inedical office center.
That a larg& portion of this plan had been completed jUEt prior to
the adoption of Ordinance No. 900.
SECTION 2. .rhat the granting of a variance aE hereinafter

recommended is necessary for the preservation of substantial prop-
erty rights of the applicant for the foregoing reasons. That the
granting of the variance as hereinafte~ recomruended will not be in-
consistent with good planning practice, nor vllth the provisions of
the master zoning plan, nor with the present or prospective develop-
ment of the neighborhood in which the property is located, but
rather in conformity with each of the foregoing. That it will make
possible the completion of a well planned and partially constructed
medical office center. Nor will the granting of the variance here-
inafter recommended adversely affect the comprehensive general plan;
nor will it be materially detrimental t,o the property or improve-
ments in the vicinity or zone in which the property is located.
SECTION 3. That the use of any portion of the premises
for e pharmacy will, however, exceed the uses presently or previ-
ously allowed in the same vicinity or zone; will set a precedent of
commercial use in~he immediate area and is not necessary for the
preservation of substantial property rights of the applicant for the
reason that subject property, at least since the adoption of Ordi-
nance No. 760, has never been useable for such cO!lllllercial purpose.s.
SECTION 4. For the foregoing reasons, this Commission
reconnnends to the City Council of the City of Arc&dia that a vari-
ance be granted to permit the above described property to be used
for the construction, maintenance and operation thereon of a medical
office building, including uses permitted in Subsections d, e, 1',
i, j, k, 1 and n of Section 8.1 A 2 of Ordinance No. 760 as amended
by Ordinance No. 900.
SECTlmr 5. The Secretary shall certify to this Resolu-
tion and shall cause a copy to be forwarded tv the City Council of
the City of Arcadia.
