DENIAL OF THE APPLICATION FOR A CHANGE OF ZOllE FROM

Dr. Emanuel Duke, as owner. for a change of zone classification from Zone :8-1
to Zone B.-3 or Zone 0-1 of certain real property described as followsl
That portion of lot 4, Tract Jio. 2409. as shown on map re-
corded in Book 23. page 23. of Maps; end that portion of lot
43. Tract Jio. 11969. as shown on map recorded in Book 259.
page 36, of Maps. records of Los Angeles County. all ~1ng
within the norther~ prolongation of the easter~ end wester~
lines of lot 39 of said Tract No. 119b9;

dul;r held on the matter b1' end before this Comm1ssion on the 14th deir of
Septenfber. 1954, at which time all interested persons were given a full oppol'-
tunit1' to be heard end to present evidence;
1lI0W, TlWREFORE, the C1 t1' Planning Commission of the Ci ty of Arcadia
does hereby-find end determine as followsl
SECTION 1. That subject propert1' abuts property of en exceptional~
high t;ype of development present~ being relloned from Zone B.-l to Zone :8-0.
That there were numerous protests to the granting of the requ.ested change of
zone b,y the owners of property in the illllDediate vicinity.
SEOTION 2. That the granting of the requeeted change of 1I0ne is not
necessary for the preeervation of substantial property righte of the applicant
for the reason that the subject property is still as desirable and usable for
the purposes for which it is end for 1'ears has been 1I0ned ae it was at the
time and prior to the :purchase thereof by- applicant. That the granting of the

requeeted change of 1I0ne would injurious~ affect adjacent properties in the
seme vicini t1' end up to now in the seme 1I0ne. particularly b,y reason of their
exceptionally high type of development and maintenance. 'l!hat there are no
exceptional circumetances applicable to the intended use of subject property.

SECTION 3. That the granting of the requeet for a change of Bone

SECTION 4. That for the foregoing reasons, this Commission reco~

cation from Zone ~ 1 to ei ther Zone ~ 3 or Zone ~l be denied.
SECTION 5. The Seoretary shall certify to the adoption of this
Besolution and. shall causs a COW to bs forworded to the City Council of the
Ci ty of Arcadia.
