RECOMMENDING THE GRANTING OF A ZONE VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID crlY TO PEJlKIT THE CONSTRUCTION. MAINTENANCE AND OPERATION OF A PAROCHIAL SCHOOL AND PLAYGROUND THEREON. WHEREAS. there Was filed with this Commission on July 6. 1954, the petition of The Roman Catholic Archbishop Of Los Angeles. as owner, requesting a varianoe affeoting the following described real property: "The Easterly 400 feet measured along the North and South lines of that portion of Lot 3 of Tract No. 950, as shown on map recorded in Book 17 Page 25 of Maps, in the office of the County Reoorder of said County, described as follows: Commencing at the Northwest corner of Tract No. 10726 as shown on map recorded in Book 185 Pages 31 and 32 of Maps, Reoords of said County; thenoe North 00 01' 30" West along the Easterly line of Holly Avenue as shown on map of Tract No. 3430. reoorded 1n Book 42 Page 32 of Maps, Records of said County, a distanoe of 33g.76 feet to the true point of beginning; thence North 81 00' East along a line parallel to the North line of said Tract No. 10726, a distanoe of 661.89 feet, more or less, to the intersection with the Northerly prolongation of the EasterlY line of said Tract No. 10726; thence North 00 00' 20. West along said Northerly prolongation of said Easterly line of Tract No. 10726 a distance of 96.35 feet, more or less to a point distant South 00 00' East 2.59 feet from the Southeast corner of the parcel of land conveyed to the Roman Catholio Bishop of Los Angeles and San Diego and described in deed recorded in Book 13328 Page 110, Official Records of said Oounty; thence South 810 00' West along a line parallel to the South line of said Parcel of land, a distance of 661.20 feet, more or less, to the intersection with said Easterly line of Holly Avenue; thence South 00 011 ~O" East along said Easterly line of Holly Avenue, 96.35 feet, more or less to the true point of beginning.", to permit the same to be used for the oonstruction. maintenance and operation of a parochial sohool and playground thereon; and WHEREAS, after due notice as required by Ordinanoe No. 760 of the City of Arcadia, a public hearing on the matter was held by and before this Commillsion on the 27th day of July, 1954, at which time all interested persons were given a full opportunity to be heard and to present evidence; - - 1 - ,/ 162 . . . . . . NOW, THEREFORE, the City Planning Commission of the City of Aroadia, Oalifornia, dOBS hereby determine and resolve as tollows: SECTION 1. That there were no protests to the granting of the varianoe requested. That the only person appearing other than in support of the application was the owner of adJaoent property who requested that adequate fencing be plaoed between his property and subJeot property. SEOTION 2. That for many years applicant has been the owner of extsnsive properties located at the southeast corner of Huntington Placs and Holly Avenue and contiguous to subject property. That at said location applioant has. for many years, lawfully maintained and operated a church and parochial achoo~ and facilities incidental thereto. That said properties and improvements are both extensive and expensive. That the tremendous growth of population 1n the Oity of Arcadia has caused a proportionate growth in the needs of and att.endanoe at applicant's facilities. That the vsry nature of applicant's aotivity reqUires the 10oation of all needed faoilities at one general location. The foregoing oonstitute exoeptional oonditions applicable to the intended use of the subject property and do not apply generally to the olass of uses in the same vioinity and zone. SECTION'. That the variance requested is neoessary for the preservation and enjoyment of the substantial property right Of the applioant possessed by other property in the same vicinity and zone. That subject property has no aocess to publio streets other than across other property of applicant already improved for and irrevooably dedioated to the uses for which a variance is requested herein. That applicant is engaged solely 1n religious, educational and charitable purposes at adjacent location and may use subJeot property only for such purposes. - 2 - 162 . . . SECTION 4. That the granting of the variance requested will not be materially detrimental to pUblic welfare, nor injurious to the property or improvements in the vioinity and zone in which the sUbJeot property is located. On the oontrary, public welfare will better be served by allowing the orderly and propsr planning and development of the facIlities required for applicant's oocupation thereat. The requested varianoe will oreate no new condition but will permit the expansion of the present laWful uses of adJaoent properties in a manner more benefioial to the vioinity and zone than if further expansion were limited to the original properties previously used for such uses. SECTION 5. That the granting of the varianoe requested . will not adversely affeot the oomprehensive general plan, but, on the oontrary. permits oontinuation of present laWful and wholssome J uses in an orderly and well planned manner. SECTION 6. That for the foregoing reasons, this Commission reoommends to the City Council that the requested six foot high varianoe bs granted upon the oondition that ~chaln link fenoe or masonry wall be construoted along the southerly line of such property connecting at its easterly end with the existing fence or wall on adjacent property of applicant; that such fence or wall be construoted prior to the use of any portion of subject property for other than single family residential purposes, and that suoh fence or wall be maintained at all times subject property is used . for the purposes permitted by the variance hereby recommended. SECTION 7. The Secretary shall certify to the adoption of this Resolution and shall oause a copy of the same to be forwarded to the City Council of the City of Arcadia.
