RESOLUTION NO. 456
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, DENYING THE REQUEST FOR
MODIFICATION OF THE FRONT YARD SETBACK
REQUIREMENTS AND DRIVEWAY REQUIREMENTS
FOR REAL PROPERil'Y LOCATED AT 936 WEST
DUARTE ROAD IN SAID CITY.
WHEREAS, there was filed with the Modification Committee
of the City of Arcadia on May 28, 1962, the application of B. M.
McKinney for a modification of the front yard setback requirements
and the driveway requirements to allow the construction of two addi-
tional buildings at the rear of the present house located at 936 West

Duarte Road in the City of Arcadia, County of Los Angeles, State of
California, d€scribed as follows:
That portion of Lot 1, Block B of the
Santa Anita Land Company Tract, per map
recorded in Book 6, page 137, o~ Maps in
the office of the county recorder of said
county described as follows:
Beginning at a point in th~ northerly line
of said Lot 1, distant ,156 '4" easterly
from the northwest corner thereof; thence
easterly along said northerly line 16 feet,;
thence southerly in a straigh~ line to a
point in the southerly line of said Lot 1,
distant easterly 272'4" from the southwest
corner thereof; thence westerly along said
southerly line 116 feet; thence northerly
in a straight line to the point of begin-
ning; except the easterly 58 feet thereof;
and,
WHEREAS, after due notice as required by the Zoning Ordinance
~ of said City, a public hearing was duly held' on the matter' by and be-
fore the Modification Committee on June 12, 1962, at ~hich time the
requested modification was denied; and,

WHEREAS, on June 22, 1962, an appeal from said decision
of the Modification Committee was filed by the applicant; and,
WHEREAS, such appeal from said decision was duly heard by
and before this Commission on the lOth day of July, 1962, at which
time all interested persons were given full opportunity to be heard
and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That this application was filed prior to the
emergency ordinance requiring two off-street parking places and, if
approved, the structures to be built would be non-conforming. That
the proposed driveway does not meet the minimum standards as required
by the Arcadia Municipal Code. That Duarte Road will eventually be
84 feet wide with 12 feet of this future right of way to come off sub~
ject property. That after such widening, the existing single family
structure would only be 16 feet back of the new right of way as com-
pared to new structures w4ich have been set back 37 feet; that even
though the applicant has submitted a revised plan, said plan still
does not provide the required two parking spaces per unit.
SECTION 2. That for the foregoing reasons, t~e decision of
the Modification Committee is hereby affirmed, the appeal therefrom
is hereby denied, and the requested modification of front yard set-
back requirements and driveway requirements to allow the construction
of two additional buildings is hereby denied.
SECTION 3. The Secretary shall certify to the adoption of
this resolution.

I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission h~ld on the 14th
day of August, 1962, by the following vote:
AYES: Commissioners Golisch, Michler, Nort,onJ Parker and
Ferguson
