RECOMMENDING THE GRANTING OF A Zo.NE VARIANCE FOR THE CONSTRUCTION AND o.PERATION OF A 60-BED CONVALESCENT HOME AT 410-418 WEST HUNTINGTo.N DRIVE IN SAID CITY. ' WHEREAS. there was filed with this Commission on May 6, 1962, the application of Robert R. stevens, as optionee, for a zone variance and/or special use permit to permit the construction and operation of a 60-bed convalescent home upon the following de- scribed property in the County of Los Angeles, State of California, to wit: Lot 29, Tract No. 2828, and the westerly 38.59 feet of Lot 30., Tract No. 2828, as shown on map recorded ,in Book 33, page 62, of Maps, records of said County, located at 410-418 West Huntington Drive; and, WHEREAS after notice required by the Zoning Ordinanc'e, as amended, of said City, a public hearing was duly held on the matter by and berore this Commission on the 22nd day of May, 1962, which said hearing was duly continued to June 12, 1962" and fur- ther.continued to June 26, 1962, at each of whiCh times all inter- ested persons were.given a full opportunity to be heard and to present eVidence; NOW. THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That there were no protests to the granting of the request. That convalescent homes as such are not specified as in a zone in the City of Arcadia, thus making a variance necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other properties in the same zone and vicinity. -1- 454 t,...-' . . . . That the location of another convalescent home within a block from subject property, as well as professional medical offices and a hospital within the near vicinity makes such a varian~e necessary for the preservation and enjo~~nt of a substantial property right of the applicant possessed by other property in the same zone and vi- cinity. That the granting of the variance. will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, but oecause the type of facility is clean and quiet and will requfre less traffic than an office or apartment building, it will have an appreciating .effect on adjacent properties. That the area is now zoned C-Q and other properties and improvements will not be adversely affected by the proposed use of subject property, but would be consistent with the general plan. SECTION 2. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance be granted to permit the use of the above desc.ribed prop- erty for a convalescent home upon the following conditions: 1. That the use of the building be so restricted that no mental patients, alcholics or contagious disease cases be admitted and kept. 2. That the applicants record an irrevocable offer of dedicat~on for 30 feet across the rear of the property for an ease- ment for alley purposes. 3. That final plan~, in substantial compliance with the . tentative plans submitted shall be submitted to and approved by the Planning Commission. 4. That grading and drainage plans be submitted to and approved by the Department of Public Works prior to issuance of a building permit. 454 -2- ',' . . . 5. That water services shall meet with the standards set up in the Uniform Plumbing Code. 6. That all parking lot illumination shall meet with the approval of the Department of Public Works and shall be shielded and directed away from adjoining properties. 7. That the property shall be enclosed on the east, south and west with a 6 ft. high masonry wall, except that such wall shall be four feet high between the front property line and . the building setback line. 8. That the variance be not operative until complete plot plans, building plans and elevations have been submitted to and approved by the Planning Commission, which shall be wi~hin one year from the date of tentative approval of the proj~~t by the City Council. That no work of clearing of the site shall be done until a building permit for the erection of the convalescent home has been issued. That such building permit shall not be issued until the plans have been approved by agencies having regulatory power over the subject matter. 9. That the Planning Commission may without further public hearings or notice thereof grant minor modifications of the conditions set out above, to the extent necessary to accom- plish the purpose of this variance. SECTION 3. The Secretary shal~.certify to the adoption of this resolution and shall cause a copy of the same to be for- . , warded to the City Council of the City of Arcadia.
