RESOLUTION NO. 451 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE RECLASSIFICATION, UPON CERTAIN .CONDITIONS, OF PROPERTY LOCATED AT 2620, 2626J 2627,2633, 2634 AND 2637 LOUISE AVENUE AND AT 55, 67, Ill, 115, 131 AND 137 LIVE OAK AVENUE FROM ZONES R-3 AND R-2 TO ZONES R-l, CO-D AND CI-D. WHEREAS, there was filed with this Commission on October 9, 1961, the application of William H. Rowland, as owner, for a change of zone from Zone R-3 to Zones 0-2 and D (Architectural Overlay) of certain property located at 2620, 2626, 2627, 2633, 26~4 and 2637 Louise Avenue and at 55, 67, Ill, 115, 131 and 137 East Live Oak . Avenue; and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a publiC hearing was duly held on said matter by and before this Commission on November 14, 1961, which hearing was duly co~tinued to December 4, 1961, and again continued to De- cember 12, 1961, for staff and zoning committee reports, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; and, WHEREAS, at said public hearing by said Planning Commis- sion, Resolution No. 438 recommending such rezoning was adopted by said Planning Commission; and, . WHEREAS, the C~ty Council of the City of Arcadia, after due notice, held a public hearing on said application, at which time all interested persons were given a full opportunlty to be heard and ~o present evidence, after which hearing_said 0ity Coun- cil referred said application back to staff for study;, and! WHEREAS, on April 10, 1962, said staff recommended that said City Council deny said application and refer the matter back -1- 451 / . . '. . . . to the Planning Comm~ssion so as to institute new proceedings and make new recommendations, which said City Council did by Resolution No. 3485 adopted April 7, 1962; and, WHEREAS, on May 8, 1962, said Planning Commission did by Resolution No. 445, institute new proceedings and make recommenda- , tions concerning the reclassification of said real property and fix the date, hour and place of a public hearing for such purpose; and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on said mat- ter by and before said Planning Commission on Tuesday, May 22, 1962, at which time all interested persons were given a full opportunity to be heard and to present evidence; . NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That subject property is located in an area . now predominately commercial. , Property across Live Oak Avenue to the south is zoned C-2 and developed for commercial uses. The north- east corner of Santa Anita Avenue and Live Oak Avenue, west of sub- ject property, is zoned C-l and developed for commercial uses. The northwest corner of Greenfield Avenue and Live Oak Avenue, east of subject property, is zoned R-3 but is developed under a variance with a medical office. That the two properties at 55 and 6J East Live Oak Avenue are respectively 105 feet and 135 feet wide! with a depth o~ approximately 459 feet and even after dedication of the alley these combined properties will be approximately 240 feet by 300 feet. SECTION 2. That the location of subject property in an area that is consistently becoming commercial warrants. the requested rezoning and the public necessity, convenience, general welfare . . and good zoning practice justifies such an action upon certain con- - - . - . .. ditions; that since the area may not all develop at one time, the -2- 451 . . '.> , . . rezoning should be made applicable as to given portions as such con- ditions affecting an individual portion are met; that any rezoning should be predicated upon the expiration or removal of any deed re- strictions still in effect; and that the residential property on the north should be properly protected by the "D" regulations. SECTION 3. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia, that the property in the City.of Arcadia, County of Los Angeles, State of California, described as follows: Parcell. Lot 10, the south 2 feet of Lot 11, Lot 18 and the north 1 foot of Lot 19, Tract No. 11438, as shown on map recorded in Book 234, page 2~, of Maps, records of said county be rezoned from Zone R-2 to Zone R-l; Parcel 2. Lots 8, 9, 19, except the north 1 foot thereof, and all of Lot 20 of said Tract No. 11438, as shown on map recorded in Book 234, page 2?, of Maps, rec?rds of said county be rezoned from Zone R-3 to Zones C-O and D, except that such change of zone shall not be effective until such time as the ~x1sting deed restrictions have been removed and evidence of such removal has b~en ,submitted to the City, at which time such rezoning may'be made with- out the necessity of further public hearings; Parcel 3. Lots 1 and 43, Tract No. 12915,a~ shown on map recorded in Book 270, page 10, of Maps, records of said county be rezoned from Zone R-3 to Zones C-l and D. Parcel 4. Lot 2 of said Tract No. 12915, as shown on map recorded in Book 270, page 10, of Maps, records of said county . be rezoned from Zone R-3 to Zones C-O and D. Parcel 5. The east 240 feet of Lot 65, Arcadia Acreage'Tract, as shown' on map recorded ih Book 10, page 18, of Maps, records of said county be rezoned from Zone R-3 to Zone R-l; however, at sucro time as a subdivision map covering the northerly portion of this property is -3- 451 .. . . . submitted and approved for the division of these lots ~nto single- family homesi tes the frontage of said property lying s~)Uth of a line extending from a point one foot south of the northeast corner of Lot 19 of aforesaid Tract No. 11438 to the northwest corner of Lot 2 of aforesaid Tract No. 12915 shall be rezoned to Zones C-O and D without further hearings; Parcel 6. That portion of Lot 99 of said Arcadia Acreage Tract bounded on the east by Lot 1 of said Tract No. 12915; on the north by Lot 42 of said Tract No. 12915; on the west by Greenfield Avenue and on the south by Live Oak Avenue be rezoned from Zone R-3 to Zones C-O and Dj except that such zoning . shall not be effective until such time as the alley is extended from the east property line of said property to Greenfield Avenue. Said alley shall be in a location and improved tostahdards meeting with the approval of the Department of Public Works. SECTION 4. That the restrictions made applicable to the said properties under Zone D shall be as follows: a. A six-foot high concrete block wall shall be constructed along the north line of Lots 9 and 19, Tract No. 11438,; along the zoning district line across the east 240 feet of Lot 65, Arcadia Acreage Tractj along the north line of Lot 2, Tract No. 12915 and along the north line of that portion of Lot 99, Arcadia Acreage , Tract, lying south of Lot 42 of Tract No. 12915. The height of said walls shall be reduced to 4 feet as they exten~ into the required front yards of the properties on Greenfield Avenue, Louise Avenue and the new street to be constructed. . b. All commercial buildings shall face Live Oak Avenue and shall be on ?uilding sites oriented from Live Oak Avenue north- e~ly to_ the concrete blo;::k wall. Lots 8 and 9 of Trac't No. n438, ., . shall be developed as one building site, and Lots 19 ~d 20 of said Tract No. 11438 shall be developed as one building site. -4- 451 .~ ;. , . . . c. No entrances to buildings from side streets shall be permitted more than ten feet from the front building line. d. Vehicular access to the subject properties shall be from the side streets rather than from Live Oak Avenue. . e. The north 5 feet of that portion of Lot 99, Arcadia I Acreage Tract, shall be landscaped and maintained as a planting strip. The south 20 feet of the north 25 feet of said property shall be paved and used for parking purposes only. f. All floodl~ghting shall be directed away from resi- dential properties. g. The height of all buildings constructed on the sub- ject property shall be limited to one-story not to exceed 16 feet in height. h. The use of all property in Zones C-Oand D shall be limited to office use. i. A plot plan showing the proposed development of the subject properties shall Qe submitted and approved by the Planning Commission prior to the issuance of any bUilding permits therefor. j. The Planning Commission or City Council may modify any of the foregoing conditions if such modification will not ad- versely affect property or improvements in the vicinity and if such modification wil~ equally accomplish substantially the same results as will adherence to the foregoing conditions. SECTION 5. The Secretary shall certify to the adoption of this resolution and Shall cause a copy of the same to be . forwarded to the City Council of the City of Arcadia.
