RESOLUTION NO. 448 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF AN APPLICATION FOR CHANGE OF ZONE FROM ZONE R-3 TO ZONE C-2 ON PROPERTY ON THE NORTH SIDE OF DUARTE ROAD WEST OF BALDWIN AVENUE IN SAID CITY. WHEREAS, there was filed with this Commission on the 19th day of March, 1962, the application of Elizabeth Revay and others, as owners, for a change of zone from Zone R-3 to Zone C-2 on prop- erty located at 745 to 805 West Duarte Road, in the City of Arcadia, County of Los Angeles, State of California, to wit: Lots 125, 126 and 127, Tract No. 2731, as shown on map recorded in Book 33 of Maps, page 29, in the office of the Recorder of said County, . and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on said mat- ter by and before this Commission on the 24th day of April, 1962, and duly continued to May 8, 1962, at each of which times all in- te~ested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DE- TERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That subject property is zoned R-3 and al- though it is near commercial property known as "The Hub", the lot immediately east of it is vacant and property further east is de- . veloped with only small businesses and a branch post office. That subject property is developed with single-family .residences, a du- plex and a dentist's office. That property to the west, also zoned R-3, is for the most part developed to that use. That property across the street is developed to residential uses, with one new apartment, with a few small businesses at the corner of Golden West. -1- 448 y' . . . SECTION 2. That there is no need for expanding commer- clal zoning at this time; that there are enough small shops on Baldwin Avenue to satisfy small store needs and there already ex- ists a modern neighborhood shopping center, complete with a grocery in the area. That the development of subject propert? to R-3 useb similar to the other new development in the area would be better than a development with more small commercial uses. That the requested rezoning, if granted, would constitute objectionable spot zoning and is not justified by good zoning practice. SECTION 3. That for the foregoing reasons, this Commis- sion recommends the denial of the requested reclassification of . the above-described property. SECTION 4. The Secretary shall certify to the adoption or this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the roregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 22nd day of AYES: May , 1962, by the following vote: Commissioners Ferguson, Forman, Michler, Rutherford and Golisch NOES: None ABSENT: Commissioners Acker and Norton Chairman .
