RESOLUTION NO. 444 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A 'ZONE VARIANCE TO ALLOW A SECOND DWELLING AT 931 SOUTH EIGHTH AVENUE. WHEREAS, there was filed with this Commission on the 12th day of March, 1962, the application of Saeed E. Murad and Gloria H. B. Murad as owners for a zone variance to allow a second dwelling on property located at 931 South Eighth Avenue in the City of Arcadia, County of Los Angeles, state of California, described as follows: The south 87.5 feet of Lot 68, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, records of said county; . and, WHEREAS, after notice required by the Zoning Ordinance of said City, a public hearing was duly held on the matter by and before this Commission on the 27th day of March, 1962, which hear- ing was duly continued to April 10, 1962, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: . SECTION 1. That there were protests, both oral and written, to the granting of the variance. SECTION 2. That subject property contains 19,250 square feet, which is more than the minimum 18,750 square foot require- ment for two houses. That the property is now improved with a single-family dwelling built in 1945 and located approximately 119 feet from the front lot line. That although the property does not -1- 444 y . . . . . comply with the requirement of having been resubdivided since 1949, there is no practical way for it to be resubdivided now, and be- cause the rear lot line thereof approximates the rear lot line of the adjacent lots resulting from the recent resubdivision thereof it was impractical to include any portion of subject property with- in such prior subdivision. That within the same block, 7 of the 18 lots contain 2 or more houses and other lots are eligible for a second dwelling without the necessity of a variance. That the foregoing constitutes exceptional conditions ~pplicable to the property invo~ved that do not apply generally to the properties in the same vicinity. That for the same reasons the requested variance is necessary for the preservation and enjoyment of a sub- stantial property right of the applicant possessed by other prop- erty in the same zone and vicinity. That the granting of such variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity and will not be inconsistent with good planning practice, nor with the present or prospective development of the neighborhood in which the property is located. SECTION 3. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance be granted to permit a second dwelling on the above- described property upon the following conditions: a. That the entire development shall substantially conform with the plot plan submitted. b. That the new house shall contain not less than 1300 square feet of floor area. c. That the existing carport attached to the present house and located on the south lot line shall be removed. -2- 444 . \ .; . . . d. That the present curb opening shall be closed and a new driveway constructed. e. That the City Planning Commission shall reserve the right, without necessity of further notice or hearing, to make minor modifications of any of the foregoing conditions, if such modification will achieve substantially the same results and will be no more detrimental to adjacent properties or impro~ements than will the strict compliance with said conditions. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
