RESOLUTION NO. 442 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING AND RECOMMENDING APPROVAL BY THE ARCADIA CITY COUNCIL OF A CHAIN LINK FENCE AT THE ~OUTHWEST CORNER OF SANDRA AN'D SECOND AVENUES AS FULFILLING THE PURPOSE, INTENT AND SPIRIT OF AND COMPLYING WITH THE FENCING CONDITIONS SPECIFIED IN A VARIANCE HERETOFORE GRANTED. WHEREAS, this Commission did on October 30, J!961, adopt its certain resolution No. 427 wherein it recommended to the Arcadia City Council the granting of a zone variance to permit the use of . property at the southwest corner of Sandra and Second Avenues for the storage of material (except fertilizer) used in connection with Harding's Gardenland, Inc. upon specified conditions; ~~d, WHEREAS, the Arcadia City Council did on November 21, 1961, grant the variance as recommended by this Commission and upon the conditions recommended by this Commission; and, ~rlEREAS, one of the conditions of said variance as recom- mended by this Commission and as granted by the City Council was that "all but the easterly twenty-three (23) feet thereof be fenced with a concrete block wall, grape stake fence or similar type of fence to screen the stored materials f,rom view"; and, WHEREAS, doubt has arisen concerning the meaning, purpose and intent of the condition hereinbefore recited and concerning the type of fencing required to fulfill the same; and, .,.... . WHEREAS, applicant has constructed a chain link fence around the area specified in said condition and is willing to cove- nant that only 'live plant material will be stored upon the property described in each of said resolutions; and, -1- 442 , . . . WHEREAS, the balance of the fencing of Hardi~g's Garden- land, Inc. is of similar construction; and, WHEREAS, with the restriction of the use of subject prop- erty for the storage of only live plant material, the ~se of a chain link fence will not only be in accordance with the balance of appli- cant's operation but will adequately fulfill the purpose and intent of the condition hereinbefore recited; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY , OF ARCADIA, CALIFORNIA, DOES HEREBY FIND AND DETERMINE ,AS FOLLOWS: SECTION 1. That under the conditions hereinbefore set forth and subject to the execution and delivery of a covenant re- stricting the use of subject property to the storage of only live . plant materi~, the installation and maintenance of a c~ain link fence on subject property fUlly accomplishes the purpose and follows the spirit and intent of the condition for walls or fences herein- before recommended by this Commission. SECTION 2. That this Commission does hereby approve the installation and maintenance of a chain link fence as fulfilling said recited condition and does hereby recommend that the Arcadia City Council similarly approve the same. SECTION 3. The Secretary shall certify to the adoption of thia resolution and shall forward a certified copy hereof to the Arcadia City Council. I HEREBY CERTIFY that the foregoing resolutiqn was adopted I at a regular meeting of the City Planning Commission held on the 13th . day of March, 1962, by the following vote: AYES: COMMISSIONERS ACKER, MICHLER, RUTHERFORD AND GOLISCH NOES: COMMISSIONERS FERGUSON, FORMAN AND NORTON ABSENT: NONE Chairman -2- 442
