RESOLUTION NO. 440 .\ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE UPON CERTAIN SPECIFIED CONDITIONS FOR THE ERECTION OF A CHURCH AND FOR AUTOMOBILE PARKING AT THE NORTHWEST CORNER OF FOOTHILL BOULEVARD AND SANTA ANITA AVENUE IN SAID CITY. WHEREAS, there was filed with this Commission on the 4th day of January, 1962, the application of the Shepherd of the Hills Evangelical Lutheran Church, as owner, signed by Rev. Ray E. Hansen, for a zone variance to permit the construction of a church and for church parking upon the following described property located at the northwest corner of Santa ~ita ,Avenue and Foothill Bo~levard in . the City of Arcadia, County of Los Angeles, State of C~lifornia, to wit: Lot 77, Tract No. 11074, as shown on Map recorded in Book 197, pages 28 and 29, of Maps, records of said County, and a part of Lot 5, Tract No. 948, as shown on Map recorded in Book 17, page 21, of Maps, records of said 0ounty, beginning at the intersection of the west line of Santa Anita. Avenue (100 feet wide) and the north line of Foothill Boulevard (80 feet wide); thence westerly along the north line of Foothill Boulevard to the east line of Lot 77, of said Tract No. 11074; thence northerly along, the east line of said Lot 77 to the south line of Lot 76 of said Tract No. 11074; thence easterly along the south line of said; Lot 76 to the west line of Santa Anita AvenUe; thence southerly thereon to the point of beginning; and, . WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a publiC hearing was duly held on said mat- ter by and before this Commission on the 23rd day of January, 1962, at which time all interested persons were given a full opportunity to be heard and to present evidence; -1- 440 .,/ . . . NOW, THEREFORE THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: . SECTION 1. That there was but one protestant to the re- quested variance. That SUbject property has a frontag~ of 349.79 feet on Foothill Boulevard and 250 feet on Santa Anita Avenue. That the corner parcel containing 250 square feet is p:r'esently zoned C-2 and has a service station on itJ that Lot 77, Tract No. 11074, which comprises the west portion of subject property, is presently zoned R-O but is not subject to the established tract restricti~ns. That applicant is also acquiring Lot 78; presently zoned R-O with tract restrictions, on which the church plans to construct a residence for the minister, which resldenc~ it is stated will comply with all such restrictions, and will serve as a buffer between the church and residential property to the west. SECTION 2. That said applicant requested a zone variance for the same purpose on January 26, 1960; that on February 23, 1960, this Commission recommended the granting of the request under cer- tain speCified conditions contained in its Resolution No. 361.; that on March 15, 1960, the City Council of the City of Arcadia granted the requested variance by its Resolution No. 3230. That because of conditions beyond the control of the applicant, the variance was not used and has expired. SECTION 3. That the intended use of the property for a church and the required parking constitute exceptional, circumstances that do not apply generally to properties or classes of use in the ~ same zone or vicinity, and the requested variance 'is' necessary for . the preservation and enjoyment of a substantial property right. That the public welfare and convenience reasonably require the grant- ing of the variance, and upon the conditions recommended said ~ari- ance will not be inconsistent with good planning practice, nor with the present or prospective development of the neighbor~ood in which property is located. -2- 440 . . I I. . . SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance be granted to permit the use of the above-described prop- erty for a church and parking upon the following condi t:ions : a. That the entire development shall conform subs tan- tially with the plot plan and ultimate site plan submi t'ted. b. That the parking lot shall be paved and separated from adjacent residential property held under separate ownership by a 6-foot masonry wall and a landscaped area in substantial com- pliance with the plot plan submitted; said masonry wall to be erec- ted concurrently with the construction of the building. c. That drainage of the property, including 'the parking lot, shall be to the satisfaction of the Director of PUblic Works. d. That any lighting of the parking lot and (grounds shall be directed away from adjacent residential property. e. That a variance from the provisions of F~re Zone No. 1 shall be granted so that the construction of the churcq building may correspond with other churches outside of No. 1 Fire Zone. f. That a variance from the setback requireIl!ents shall be granted affecting Lot 77~ Tract No. 11074, to allow the building at 25 feet from Foothill BOUlevard instead of the required 50 feet. g. That the final plot plan, landscaping plans and build- ing plans shall be submitted to and first be approved by the Planning Commission before issuance of a building permit. h. That sidewalks of a minimum width of 5 feet shall be constructed on all portions of Santa Anita Avenue and Foothill Boule- vard where there are no existing sidewalks. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. -3- 440 . . . .
