RESOLUTION NO. 438 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNrA, RECOMMENDING THE RECLASSIFICATION, UPON CERTAIN CONDITIONS, OF PROPERTY LOCATED AT ~626, 2633, 2634. AND 2637 LOUISE AVENUE AND AT 55, AND 67 'EAST LIVE OAK AVENUE FROM ZONE R-3 TO ZONES C-2 AND 'D iARCHITECTU~L OVERLAY) . WHEREAS, there was filed with this ,Commission on Octo- ber 9, 1961, the application of William H. Rowland, as owner, for a change of zone from Zone R-3 to Zones C-2'and D (Architectural Overlay) of certain property located at 2626, 2633~ 2634 and 2637 Louise Avenue and at 55 and 67 East Live Oak Avenue; and, WHEREAS, after notice required by the Zoning Ordinance . of said City, as amended, a public hearing was duly held on said matter by and before this Commission on November 14, 1961, which hearing was duly ~ontinued to December 4, 1961, and again continued to December 12, 1961, for staff and zoning committee reports, at each qf which times all interested persons were given I a full oppor- tunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That subject property is locate~ in an area now predominately commercial. Property across Live Oak Avenue to the south is zoned C-2 and developed for commercial uses. The north- east corner of Santa Anita Avenue and Live Oak Avenue, west of sub- . ject property, is zoned C-l and developed for commercial uses. The northwest corner of. Gre e.nfield Avenue and Live Oak Avenue, east of subject property is zoned R-3 but is developed under a. variance with a medical office. That the two properties at 55 and ,67 East Live Oak Avenue are respectively 105 feet and 135 feet wide with a depth of approximately 459 feet and even after dedication df the alley these combined properties will be approximately 240 feet by 300 -1- 438 V' . .- . . SECTION 2. That the location of subject property in an area that is consistently becoming commercial warrants the requested' rezoning and the public necessity, convenience, general welfare and good zoning practice justifies such an action upon certain condi- tions; that since the area may not all develop at one time, the rezoning should be made applicable as to given portions as such conditions affecting an individual portion are met; that any re- zoning should be predicated upon the expiration or removal of any deed restrictions still in effect; and that the residential property on the north should be properly protected by the liD" regulations. SECTION 3. That for the foregoing reasons, this Commis- sion recommends to the City Council of the 0ity of Arcadia, that the property in the City of Arcadia, County of Los Angeles, state of California, described as follows: Lots 8, 9 and 20, and Lot 19, except the nOrth one foot thereof, Tract No. 11438, as shown on map recorded in Book 234, page 22, of Maps, records of said County; and that portion of Lot 65, Arcadia Acreage Tract, as shown on map recorded in Book 10, page 18, of Maps, records of said County, described as follows: Beginning ata point in the east line of Lot 19 of said Tract No. 11438 distant South thereon 1 foot from the northeast corner of said lot; thence South to the southeast corner of Lot 20 of said Tract No. 11438; thence northeast along tJ:1e northerly line ot: LIve Oak Avenue to the southwest corner of Lot 2, Tract po. 12915, as shown on map recorded in iBook 270, page 10, of Maps, records of's,aid Couhty; thence ,North to the northwest corner of said Lot 2; thence southwesterly in a direct line to the point of beginning, be rezoned to Zone C-2 and Zone D (Architectural Overlay) upon the . following conditions: . a. That the east 12 feet of Lots 8 and 9 and the west 12 feet of Lots 19 and 20, Tract No. 11438, including radii at the corners of Live Oak Avenu~ be dedicated for street purposes for the widening of Louise Avenue. . b. That the north 25 feet of Lot 9 and the north 25 feet -2- 438 . . . of Lot 19, Tract No. 11438, and a strip 25 feet wide across the east 240 feet of Lot 65, Arcadia Acreage Tract be dedicated for alley purposes, the north line of said alley to coincide with the north line of Lot 2, Tract No. 12915. c. That a 60-foot street, including radii at Live Oak Avenue and a turnaround at the north end, through the east 240 feet of Lot 65, Arcadia Acreage Tract, extending from Live Oak Avenue to the above-mentioned alley be dedicated. d. That the above dedications shall be made prior to the recommended zoning becoming effective, and in no c~se later , than five years after the adoption of any ordinance approving such rezoning. . e. That the ordinance approving the requested rezoning shall provide that dedications and development of the area be made as an entire unit, or by stages with respect to the following par- cels: Parcell. Parcel 2. Parcel 3. Lots 8 and 9, Tract No.n438 Lots 19 and 20, Tract No. 11438 The east 240 feet of Lot 65, Arcadia Acreage Tract f. That the change of zone shall not become effective until such time as the deed restrictions on the proper~y have been removed and evidence of this removal submitted to the Planning Com- mission. SECTION 4. That the following restrictions shall be imposed under the Zone D (ArChitectural Overlay) hereihabove recom- mended: . I a. That a concrete block wall be constructed along the north line of the alley to separate the alley and the commercial property from the residential property to the north; that a con- crete block wall be constructed to separate publiC parking areas from street frontages; and that the layout of all such parking lots, -3- 438 ~. j.... . . . . including walls, landscaping and drainage, shall be subject to the approval of the Director of Public works. b. That prior to or concurrent with the erection of any commercial structures, the applicable dedications shall be improved for street and alley purposes in accordance with City standards. c. That all commercial buildings shall face Live Oak Avenue and shall be on building sites extending from Live Oak Ave- nue to the alley required to be dedicated. d. That no entrances to buildings from side streets shall be permitted more than ten (10) feet from the front building line. e. That vehicular access to all portions property shall be by means of the alley required to of; the subject I be dedicated . and improved, as distinguished from access by means of curb cuts in Live Oak Avenue and the side streets. f. That all billboards shall be prohibited. g. That all floodlighting shall be directe~ away from residential properties. h. That the planning Commission or City Council may modify any of the foregoing conditions if such modific.ation will not ad- versely affect property or improvements in the vicinity and if such modification will equally accomplish substantially th~ same results as will adherence to the foregoing conditions. SECTI9N 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded I. to the City Council of the City of Arcadia.
