RESOLUTION NO. 437 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE C~TY OF ARCAD~A, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO ALLOW THE CONSTRUCTION OF AN ADDITION TO THE EXISTING BUILDING AT III EAST LIVE OAK AVENUE. WHEREAS, ,there was filed with this Commission on the 6th , . day of'October, 1961, the application of H: N. Berger and Fran- ces C. Berger as owners for a zone var~ance to allow the construc- tion of an addition to the existing building and to permit the use , of such addition for medical offices, on property loc~ted at III I East Live Oak Avenue in the City of Arcadia, County of Los Angel~s, state of California, described as follows: Lot 2, Tract No. 12915, as shown on map re- corded in Map Book 270, page 10, records of said County; '. and, WHEREAS, after notice required by the Zoning Ordinance of said City, a ,public hearing was duly held on the matt~r by and be- fore this Commission on the 14th day of November, 1961, which hear- ing was duly continued to December 4, 1961, and still further duly continued to December 12, 1961, at each of which times all interested per -- _0- _........__ _.L._ 'l....... .1...........""'A '=l.nd,i-~t:U:!oClt::J.T\_t e' .",' j~ . . .. . alley. Subsequently Lot 3 was sold and an apartment house con- structed thereon. SECTION 2. That the south side of Live Oak Avenue is zoned and developed for commercial uses. That there is commercial development on the north side of Live Oak'Avenue east of subject property'and an application is now pending for commercial zoning of properties on the north side of Live Oak Avenue west of subject property. That the requested variance is necessary for the preser- . ' vation and enjoyment of a substantial property right of the appli- cant possessed by other property in the vicinity and its use as a professional office building constitutes an exceptional circumstance which would not apply generally to property in an R-3:Zone. That under the conditions hereinafter specified the granting of a vari- . ance will not be detrimental to public health or welfare, will not be harmful or detrimental to the residential property to the north, nor adversely affect the comprehensive general plan. 1.1 I / I / SECTION 3. That the proposed use of subject property for which the variance is requested is a commercial use a~d recognized as such by the classification thereof as a use permissible in Zone c-o. That the commercial use of property causes a great increase in the amount of vehicular traffic in the immediate vicinity of ,the prq - - - --~.._- --- ro+-__'~"", 'Ln-ro_~p.Rf\ed__amount~of t' ". . .. . ,.' . SECTION 4. That for the foregoing reasons, :this Commis- sion recommends to the City Council of the City of Arcadia that a zone variance be granted for the construction of an addition to the existing building on the property hereinabove describ~d, subject to I . the following conditions: a. That the east 12 feet of Lot 2, includi~g the corner radius, be dedicated for the widening of Greenfield A~enue. b. That the north 25 feet of Lot 2 be dediqated for pub- lic alley purposes. c. That a concrete block wall be construc~ed on the north property line of SUbject property, said wall to be four (4) feet high from the west line of Greenfield Avenue for a distance of twenty-five (25) feet and six (6) feet high for the balance thereof. d.' That the property dedicated for the all~y and/or the widening of Greenfield Avenue be improved in accordance with City standards prior to or concurrent with any building construction on subject pro~erty. i e. That the new portion of the building comply I requirements of Fire Zone No. 2 and conform substantially I with the with the building plans submitted with the application. f. That the present setback of fifty (50) feet fr6m Live Oak Avenue be removed. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy t"o be forwarded to the , . City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 9th day of January , 1962, by the following vote?
