A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE eITY OF ARCADIA, CALIFORNIA, RECOMMENDING INTERIM EMERGENCY ZONING OF PR-2 UPON CERTAIN CONDITIONS CONCURRENT WITH ITS ANNEXATION TO 'THE CITY OF ARCADIA, OF I' CERTAIN PROPERTY KNOWN AS rr ANNEXATION NO.. 28, SO'UTHEAST ARCADIA UNINHABITED. Ii WHEREAS, pursuant to the Annexation of Uninhabited Terri- tory Act of 1939, as amended, the City Council of the City of Arcadia, proposes to annex to the City of Arcadia that certain unin- ., habited territory contiguous and adjacent to the southeasterly portion of the City of Arcadia, which territory has b~en designated and is known as "Annexation No. 28, Southeast Arcadia Uninhabited"; and, . WHEREAS, Section 9232.6 of the Arcadia MuniCipal Code pro- vides that all property annexed to the City of Arcadia and not otherwise classified concurrently with its annexation'shall be classified and placed in Zone R-l; and, WHEREAS, Section'65806 of the California Government Code provides in part that in the event new territory may be annexed to . , the city, the legislat~vebody to protect the publiC ~afety, health and welfare, may adopt, as an urgency measure, a temporary interim zoning ordinance prohibiting such and other uses which may be in I conflict with such zoning ordinance; and, . WHEREAS, Section 9294.5 of the Arcadia Municipal Code pro- vides ,for the zoning of unincorporated territory concurrent with its annexation to the City of Arcadia; and, WHEREAS, after notice as required by the Zoning Ordinance of said City, a public hearing was duly held on the m'atter by and before this Commission on November 28,'1961, which he~ring was duly continued to December 4, 1961, at each of which times all interested persons were given. full opportunity to be heard and to present evi- I.... -1- 433 v ,~" . . . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: . . SECTION 1. That the North 24.66 feet of su~ject property belongs to the owner of the lot adjacent on the north at the south- east corner of Live Oak Avenue and Lenore Avenue; that the balance of subject property is owned by the Arcadia Friends Church; that the north 116 feet of said church prope~ty is 9.evelope;d as a parking lot for the, church with paving, landscaping, lighting,' sidewalk and I an ornamental block wall along the north, east and south sides. I That there is a contemplated use of the south 67 feet,: presently vacant, as a church parsonage. SECTION 2. That subject church property is presently R-3 . under county zoning; that property across the street i!s presently zoned R-2 and used for a church and a parking lot; and all of the surrounding county area to the east, south and southwest is zoned zoning would developed with single family residences. That to insure its proper development, a covenant I I. I should be required guaranteeing its ownership in common with that of the adjacent corner lot and restricting its use to open or covered parking only. SECTION 4. That for the foregoing reasons this Commission , recommends that the fOllowing property in the County of Los Angele~, State of California, described as follows: -2- 433 . ' . . . . . . Beginning at the point of intersection of t~e boundary of the City of Arcadia as same existed on August 23, 1961, and the westerly line of Tract No. 15233, as shown on map recorded in Book 332, pages 29 and 30, of Maps, in the office of the Re.corder of said County'; thence southerly along said westerly line to a point 2 feet northerly measured along said westerly line from the northeast corner of Lot 69, Tract No. 16917, as shown on map recorded in Book 386, pages '47 to 50 inclusive, of Maps, records of said CountYJ thence westerly parallel with the northerly line of said Lot to the first point of intersection with the boundary of the City of Arcadia; thence northeasterly, northerly and easterly along'said boundary through its various courses and distances to the point of beginning, : be placed in Zone PR-2 concurrent with its annexationito the City of Arcadia and that a required condition of the rezontng be the exe- cution of a covenant guaranteeing that the north 24.69 feet be held , , in common ownerShip with that real property in the City of Arcadia, County of Los Angeles, State of California, described as followSI Part of Lot 12, Western Two-Thirds Rancho San Francisquito, as shown on map recorded in Map Book 42, page 47, records of said County: Lot commencing at the northwest corner of Lbt 1, Tract No. 15233; thence South 80009'15" West 75 feet; thence South 35009'15" West 35.36 feet; thence South 9050'45" ,East 169.66 feet; thence North 80009'15'~ East 100 feet; thence North: 9050'45" ,West 194.66 feet to beginning; exc~pt the so~therly 24.66 feet, thereof, and restricting the use of said North 24.66 feet to open or covered pa:t'king. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregOing resolution was adopted at a regular meeting of the City Planning Commission held on the 12th day of December, 1961, by the following vote: AYES: NOES: Commissioners Acker, Ferguson, Forman, Michler, Rutherford, Norton and Golisch None ABSENT: None Chairman! -3- 433
