RESOLUTION NO. 427 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OFA ZONE VARIANCE TO PERMIT THE USE OF PROPERTY AT THE SOUTHWEST CORNER OF SANDRA AND SECOND AVENUES FOR THE STORAGE OF SPECIFIED MATERIAL USED IN CONNECTION WITH HARDING'S GARDENLAND, INC. WHEREAS, there was filed with this Commission on the 19th I day of September, 1961, the application of Charles E. Harding, Jr., I as lessee, for a zone variance to permit the use for storage of material used in connection with the operations of Harding'S Garden- I land, Inc., of property located at the southwest corner of Sandra . and Second Avenues in the City of State of California, specifically I Arcadia, County of Los I described as follows: I Angeles, That portion of Lot 4, Tract No. 12670, as shown on map recorded in Book 245, page 47, of Maps, records of said County, bounded on the north! by' Sandra Avenue, on the east by Second Avenue,' on I the south by the first alley north of Live O~ Avenue, and on the west by a line parallel with the west line of said Lot 4 and distant 181.65' feet easterly therefrom; and, I I WHEREAS, after notice required by the Zoning Ordinance I of said City, as amended, a publiC hearing was duly held on the matter by and before this Commission on the lOth day of October, : ' 1961, at which time all interest.ed persons we,re given ~ full opp~r- tunity to be heard and to present evidence; I I NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY . DETERMINES AND RESOLVES AS FOLLOWS: 427 .. . . . ~ the property south of it facing on Live Oak Avenue was zoned for commercial uses, it has never been graded or paved; that up to this time the filling station on the corner and the doughnut shop west 01' the station have had no need of additional parking area. SECTION 2. That the extremely narrow width of subject property and its ~usual length constitute an exceptional circum- stance applicable to the property that does not apply generally to other properties in the same vicinity and zone. That the narrow width of subject property precludes its use for any purpose per- mitted under its basic zoning of R-3. That its only use for tran- , sient parking as permitted in Zone P would be in connection with the adjacent properties, one of which is developed and used for an ~ automobile service station and the other for a doughnut shop, each of which businesses already have far more parking than, is required to satisfy their daily needs. That the granting of the variance as hereinafter provided is necessary for the preservation and en- joyment of property rights possessed by other properties in the ~ same vicinity and zone, namely the right to use the same for some reasonable and lawful purpose. That with proper conditions and restrictions, the granting of the requested variance ftor the pres- ent and un.til such time as the commercial development in the area requires the use of subject property for parking would not be detri- mental to the publiC health or welfare or injurious to property or improvements in the vicinity, nor would it adversely affect the com- prehensive general plan. SECTION 3. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance for a five-year period be granted to allow the storage , upon subject property of ~aterial used in connection with the opera- , I Harding's Gardenland, Inc. upon the following conditions: ~2- 427 . . . . a. That the entire area of subject property1be graded, (23) feet thereof be fenced I and all but th~ easterly twenty-three with a concrete block wall, grape stake fence or a s1m+lar type of fence to screen the stored materials from v.iew. b. That any portion of such a fence constructed within twenty-three (23) feet of Second Avenue be no higher than the exist- ing wall along the south side of Sandra Avenue at this location, and that no storage of materials shall be permitted within the east- erly twenty-three (23) feet of subject property. I c. That no fertilizer b,e stored on subject property and , that no paint spraying be done thereon. d. That all materials stored on the property with the . exception of tubbed trees shall be kept below the height of the adjacent wall along the south side of Sandra Avenue. I SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted ,an ad ,1 ourned at / regular meeting of the City Planning Commission held on the 30th day of October, 1961, by the following vote: AYES: Commissioners Ferguson, Forman, Rutherford and Golisch NOES: None ABSENT: Commissioners Michler and Norton .
