RESOLUTION NO. 423 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARIANCE TO ALLOW THE ERECTION OF A CHURCH AND RELATED FACILITIES AT 130 WEST DUARTE ROAD IN SAID CITY. WHEREAS. there was filed with this Commissiop on the 18th day of August, 1961, the application of American Lutheran Church of Arcadia. as lessee, signed by W. F. Danneman, Pastor, ~or a zone variance to permit the erection of a church, including Sunday School classrooms, kitchen facilities and automobile parking, on property at l30WeSt Duarte Road in said City of Arcadia, County of iLos Angeles, . State of California, described as follows: Part of Lot 4~ Santa Anita Colony, as shown on map recorded in Book 42, page 87. Miscellan~ous Records of said County, Commencing South 810 West 384.34 feet from the Northeast corner of ,said Lot 4; thence South 810 West 160 feet; thence South 334.15 feet; thence North 89002' East 158.04 feet; thence North to the beginning; and, WHEREAS, after due notice as required by the Zoning Ordi- nance of said City, a public hearing was duly held on the matter by and before this Commission on the 12th day of September, 1961, which hearing was duly continued to September 26, 1961, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DE- TERMINES AND RESOLVES AS FOLLOWS: SECTION 1. Only those financially interested in the property spoke in ,favor of the variance. SECTION 2. That subject property is zoned R-l and contains I apprOximatelY 1.32 acres which, while it would meet t4e minimum re- quirements for off-street parking, with the present plans for the church area and its related facilities could create a traffic prob- lem detrimental to the neighborhood. That subject property and the lots on either side of it are deep lots zoned R-l and constitute a problem that . should be considered in the development of the area as a whole rather than individually lot by lot; that any exceptional or extraordinary circumstance or condition is applicable to all the lots facing on that side of Duarte Road and not alone to subject property. That since there is a possibility that the variance could not be used for a year, the granting of the variance is not necessary at this time for the preservation of any property right. That sinc.e the granting of the variance at this time could be considered spot zon- ing, it might well be detrimental tq other properties 'in the neigh- borhood and would certainly adversely affect the comprehensive gen- eral plan. SECTION 4. I , That for the foregoing reasons, Ithis Commission . recommends to the City Council that the requested variance to permit the erection of a church and related facilities on the above-described property be denied. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded the City Council of the City of Arcadia. -2- 423 " i . . .
