RESOLUTION NO. 418
A RESOLUTION' OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA,' RECOMMENDING INTERIM
EMERGENCY ZONING OF R-3 AND D
(ARCHITECTURAL OVERLAY) CONCURRENT
WITH ITS ANNEXATION TO THE CITY OF
ARCADIA, OF CERTAIN PROPERTY KNOWN
AS "ANNEXATION NO. 26, WEST ARCADIA
UNINHABITED .n

WHEREAS, pursuant to the Annexation of Uninhabited
Territory Act of 1939, as amended, the City Council of the City
of Arcadia proposes to annex to the City of Arcadia that certain
uninhabited territory contiguous and adjacent to the westerly
portion of the City of Arcadia, which territory has be~n d~signated
and is known as "Annexation No. 26, West Arcadia Uninhabited"; and,
WHEREAS, Section 9232.6 of the Arcadia Municipal Code
provides that all property annexed to the City of Arcadia and not
oth~rwise classified concurrently with its annexation ;shall be
classified and placed in Zone R-l; and,
wHEREAS, Section 65806 of the California Government Code
provides in part that in the event new territory may Qeannexed
to the city, the leg~slative body to protect the public safety,
heal th and welfare, may adopt, as an urgency measure, ,a temporary
interim zoning ordinance prohibiting such and other uses which may
be in conflict with such zoning ordinance; and,
WHEREAS, Section 9294.5 of the Arcadia MuniCipal Code
provides for the zoning of unincorporated territory cQncurrent

with its annexation to the City of Arcadia; and,
WHEREAS, after notice as required by the Zoning Ordinance
of said City, a publiC hearing was duly held on the matter by and
before this Commission on the 8th day of August, 1961, which hear-
ing was duly continued to August 22, 1961, at each of Which times
all interested persons were given a full opportunity to be heard
to present evidence;

NOW, THEREFORE, THE CITY PLANNING COMMISSION :HEREBY
DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That subject property is a lot 130 feet by
350 feet developed with a single family dwelling. That if it were
annexed and automatically became R-l zoning, no additional dwelling
units would be permitted except by an approved subdivision and it
would be the only lot zoned R-l in that portion of theiCity. That
although there were numerous protests to the R-3 zoning, there is (
other R-3 zoning in the neighborhood and commercial zoning within
a short distance on the same street. That under certain conditions,
the development of the property for R-3 uses would be a benefit to
the neighborhood and to the development of the city as a whole.

SECTION 2.
That ,for the foregoing reasons this Commission

recommends that property located at 1167 West Duarte Road in the
County of Los Angeles, State of California, described as Lot 1,
Tract No. 10815, as shown on map recorded in Book 188, pages 7 and
8, of Maps, records of said County, be placed in Zone R-3 and Zone
D (Architectural Overlay) and that the following restrictions should
be made applicable to said property under said Zone D (Architectural
Overlay) :
a. That no apartment house thereon construc,ted shall
exceed one story in height nor shall it be more than ~ighteen (18)
feet in height above the final grade.
b. That the front, side and rear yards shall comply
. with the provisions of Title 2, Division 5, Part 5, Chapter 2,
Article IX of the Arcadia Municipal Code.
c. That a concrete block wall be constructed along the
west side of the lot to prohibit access to Greenwood Avenue.

SECTION 3. The Secretary shall certify to the adoption
of this resolution and shall cause a copy of the same to be forwarded
to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the 12th
day of
September, 1961, by the following vote:

Commissioners Acker, Ferguson, Forman, Michler,
Norton, Rutherford and Golisch
