RESOLUTION NO. 416 A RESOLUTION ,OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDJ;NG THE DENIAL OF A ZONE VARIANCE TO ALLOW PROPERTY AT 39 AND 43 CHRISTINA STREET TO BE USED AS A HOME FOR PAYING GUESTS OVER 65 YEARS OF AGE. I WHEREAS, there was filed with this Commission on the 13th day of July, 1961, the application of George W. Gilbert as . owner and C. M. Rhodes, as lessee, fora zone variance to permit the use for housing, dining and recreation of paying guests over sixty-five years of age of property at 39 and 43 Christina Street in said City of Arcadia, County of Los Angeles, State o~ Ca11~ornia, described as follows: Lot 19 and the east 6.05 feet of Lot 20, Tract No. 13252, as shown on map rec.orded in Book 345, pages 6, 7 and 8, of Maps, records of said County; and, WHEREAS, after notice required by the Zoning Ordinance of said City, a public hearing was duly held on the matter by and before this COmmission on the 25th day of July, 1961, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: . SECTION 1. That there were numerous protests, both oral and written, to the granting of the variance on the grounds that the proposed use of the property would be commercial and thereby depreciate the value of the residential property on tne south side of Christina Street. That only those with a financia~ interest in the proposed project spoke in favor of it. -1- 416 y" .~ . . . SECTION 2. That subject property is zoned R-3 with an alley at the rear; that the R-3 zoning was established, to provide a buffer bet~een the commercial zoning of property on the north facing on Duarte Road and the R-2 residential property on the south side of Christina Street. That the property to the west is also zoned R-3 and developed with apartment houses. That the property between Santa Anita Avenue and First Avenue e~tending south from Christina Street is zoned R-l and so developed. That property to the east is a parking lot, with a church on the south side of Christina Street. That subject property is developed for R-3 uses and there are no exceptional or extraordinary circumstances applicable to subject property nor is the requested variance . necessary for the preservation of any property right of the appli- cant possessed by other property in the same zone and vicinity. That the establishment of R-3 zoning between commercial and resi- dential zoning has long been considered good planning practice; that to allow a variance for a commercial enterprise would not only be injurious to the property and improvements in the neigh- borhood but to the comprehensive general plan. SECTION 3. That for the foregoing reasons, this Commis- sion recommends to the City Council that the requested variance , I for use of the property above described as a home for paying guests over sixty-five years of age be denied. SECTION 4. The Secretary Shall certify to the adoption ~ of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia.
