RESOLUTION NO. 415 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT THE USE OF PROPERTY AT 745 AND 751 NAOMI AVENUE IN SAID CITY AS A PUBLIC AUTOMOBILE PARKING AREA. WHEREAS, there was filed with this Commission on the 26th i of June, 1961, the application of Arcadia Parking, Inporporated, . as owner, Signed by Marvin T. Launius, Jr., Vice Pres~dent, for a zone variance to permit tfle use as a public automobil~ parking area of the property at 745 and 751 West Naomi Avenue in said city; and, WHEREAS, after notice given as required by ~he Zoning Ordinance of said City, a public hearing was duly hel~ on the matter by and before this Commission on the 11th day of JUly, 1961, at which time all interes~ed persons were given full op~ortunity to be heard and to present evidence; J NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY I DETERMINE AND RESOLVE AS ~OLLOWS: SECTION 1. That there were no protests, either oral or I written, to the granting of the requested variance. That subject property is presently zoned R-2 and the lot at 745 Naomi Avenue could be used for parking without the requested variance under Sec- tion 9253.1.7 of the Arcadia Municipal Code. That tl').e property to the east, owned by the applicant and zoned C-2, is used for a park- ing lot; to the north is a parking lot for a church; 'across the . street to the southeast is the parking lot for. .a. lar.gemarket~ and while the property adjoining on the west is zoned R-2, it is the headquarters .for a transf,er and storage company under a non-conform- ing use. That under prior ownership subject property was used as I a commercial plant nursery. -1- 415 v , ' / .. .>..( . . . . . SECTION 2. That the fact that subject prop~rty is sur- rounded by parking lots and R-2 property developed to non-conforming commercial uses constitutes an exceptional circumstance applicable to subject property which does not apply generally to, other proper- ties' zoned R-2 in the neighborhood, and the requested varianc,e is necessary for the preservation and enjoyment of a subst~tial prop- erty right possessed by other properties in the same ;zone and vicinity. That the granting of the requested variance under the conditions. hereinafter recommended will not be detrimental to the I publiC health or welfare, will not be inconsistent wi:th good plan- ning or With the present or prospective development df the neigh- , I borhood in which the property is located, but rather will foster the development of the area by providing needed addi~ional parking facilities. SECTION 3. That for the foregoing reasons :this Commis- sion recommends to the Arcadia City Council that a variance be granted to permit the use of the property at 745 and '751 West . , I Naomi Avenue in the City of Arcadia, County of Los Angeles, State I of California, described as follows: The easterly 122 feet of the westerly 244.7;-7 feet of Lot 2, Santa Anita Land Company's Pumping Plant No. 1 Tract, as shown on map recorded in Book 10, page 183, of Maps, records of said county, excepting the northerly 20 feet and the southerly 25 feet thereof, to be used as a publiC automobile parking area upon the following conditions: a. That a concrete block wall be constructed along the west property line, the front twenty-five (25) feet ~hereof ~o be four (4) feet high and the remainder to be six (6) f~et high; b. , , That curb, gutter and sidewalk be constructed along the front of subject property and along the 100.9 foot frontage of I , in accordance with Cit~ specif~ca- the lot adjacent on the east, tions and to grades approved by the Director of Publfc Works; -2- 415 '\ It' . . . . . . c. That the property used for parking be paved; d. That grading plans of subject property be approved by the Department of Public Works. e. That tree planting and landscaping shall be installed and maintained to conform with the landscaping and tree planting now existing on the parking lot adjacent and east of subject prop- erty ~d owned by applicant. f. That except as hereinbefore expressly provided to the contrary, said property shall be improved and maintained as pro- vided in the Arcadia Municipal Code and particularly S~ction 9284.4 thereof, with respect to public parking areas. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the Arcadia City Council. I HEREBY CERTIFY that the foregoing resolutipn was adopted at a regular meeting of the City Planning Commission held on the 8th day of August, 1961, by the following vote: AYES: Commissioners Ferguson, Forman, Michler, Rutherford and Acker NOES :, None ABSENT: Commissioners Golisch and Norton Chairman ATTEST: -3- ; 415
