RESOLUTION NO. 414
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE GRANTING
OF A ZONE VARIANCE TO PERMIT THE
PLACING AND MAINTENANCE OF TWO
DUPLEXES AlID GARAGES ON PROPERTY AT
920 SOUTH SECOND AVENUE IN SAID CITY.
WHEREAS, there was filed with this Commission on the 28th
day of June, 1961, the application of Dr. C. M. Baxter, as owner,
for a zone variance to permit the moving of two duple~es from 142,
144, 146 and 148 East Foothill Boulevard to 920 South Second Ave-
nue and the maintenance and use of the said two duplexes at said
latter address; and

WHEREAS, after notice given as required by the Zoning
Ordinance of said City, a public hearing was duly hel~ on the mat-
, ter by and before this CoMmission on the 11th day of ~uly, 1961, at
which time all interested persons were given full opportunity to be
heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY
DETERMINE AND RESOLVE AS FOLLOWS:

SECTION 1. That there were no protests, either oral or
written, to the granting of the requested variance; that the owners
of many adjacent and nearby properties indicated their concurrence
with the request by signing petitioner's application. That the two
buildings to be moved onto the subject property are in good condi-
tion, attractive and built strictly in accordance with Arcadia's
standards; that the buildings presently located on subject property
and to be removed therefrom are old and delapidated.
SECTION 2. That subject property is located directly
across an alley from C-l property, is 80 by 108.46reet in size and
contains 8676 square feet of area. That although Zone R-2 ordinarily

. allows but one duplex on a lot this size, subject pro~erty could be,
used for a three or four family dwelling pursuant to Section 9253.1.3
of the Arcadia Municipal Code if it were not separated from the com-
mercial property by the existing alley. That the foregoing consti-
tutes an exceptional circumstance applicable to subject property
which does not apply generally to other properties in the same zone.
That the granting of the requested variance will not be detrimental
to the public health or Welfare, will not be inconsistent with good
planning or with the present or prospective development of the
neighborhood in which the property is located, but rather nIl im-
prove the area, and is necessary for the enjoyment of substantial
IJropertY,rights possessed by other properties in the same zone and
vicinity.

SECTION 3. That for the foregoing reasons this Commission
recommends to the Arcadia City Council that a variance be granted
to allow the moving of two duplexes and garages from 142, 144, 146
and 148 East Foothill Boulevard to the property in the City of
Arcadia, County of Los Angeles, State of California, described as
follows:

The southerly 80 feet of the westerly 120.46
feet of Lot 33, Tract No. 808, as shown on map
recorded in Book 16, pages 82 and 83, of Maps,
records of said County, excepting therefrom the
westerly 12 feet thereof,
known as 920 South Second Avenue, upon condition that they be placed
thereon in accordance with the plot plan submitted by applicant, be
located at the Second Avenue setback line and nth a driveway at the
rear with a minimum width of th:l:~teen (13) feet.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
Arcadia City Council.

I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the 11th
day of July, 1961, by the fOllowing vote:
AYES: Commissioners Ferguson, Golisch, MiChler, Norton,
Rutherford and Forman .
NOES: None
ABSENT: Commissioner Acker
