RESOLUTION NO. 412 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE CLASSIFICATION OF THE BUSINESS OF DISTRIBUTION OF ELECTRONIC COMPONENTS AS A WHOLESALE BUSINESS, A USE PER- MISSIBLE IN ZONE C-M UNDER CHAPTER 2 OF ARTICLE IX OF THE ARCADIA MUNICIPAL CODE. WHEREAS, there has been requested a classification under Chapter 2 of Article IX of the Arcadia MuniCipal Code of the busi- ness of distribution of electronic components; and, . I~AS, ambiguity has arisen concerning the appropriate classificdtion of such use within the meaning and intent of said Chapter 2 of Article IX of the Arcadia Municipal Code; and, WHEREAS, Section 9213 of said Municipal Code provides in part that "if ambiguity arises concerning the appropriate classi- fication of a particular use within the meaning and intent of this Chapter . it shall be the duty of the Pll:l.l1ning Commission to ascertain all pertinent facts concerning said use and by resolution of record set forth its findings I:l.I1d the reasons thereforj" and, WHEREAS, at a regular meeting of the City Planning Com- mission said Commission ascertained all pertinent facts concerning the use of property for distribution of electronic components; . NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA DOES HEREBY FIND, DETERMINE, RESOLVE AND RECOMMEND AS FOLLOWS: SECTION 1. That ThOmas A. Lynch proposes to conduct within the City of Arcadia the business of distributing electronic components. That he estimates that between 25% and 33% of his gross business will be subject to the California Retail Sales Tax. -1- 412 / .- .. . . That though a numerical majority of individual sales conducted thereby will be to the ultimate consumer, it appears that a .major portion of the gross sales volume will be not to the ultimate con- sumer but to manufacturers for resale; that except for the fact that large quantity buyers can buy directly from the manufacturing supplier at lower prices, the percentage of gross sales to other than ultimate consumers would be even greater. SECTION 2. That for the foregoing reasons, although this type of business is not noisy nor patently obnoxious and at least at the outset would not be uncomplimentary to the immediate community, this Commission finds and determines, from the evidence ~ presented to it, that the business of distributing electronic com- ponents as proposed to be conducted by Thomas A. Lynch, is primarily a wholesale business and as such would and should properly be clas- sified as a use permissible in Zone C-M. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 27th day of June, 1961, by the following vote: AYES: NOES: Commissioners Ferguson, Forman, Golisch.
