RESOLUTION NO. 411 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF A NEW DWELLING ON THE FRONT PORTION OF THE LOT AND TO RETAIN THE EXISTING DWELLING ON THE REAR PORTION OF THE LOT AT 535 EAST CAMINO REAL IN SAID CITY. WHEREAS, there was filed with this Commission on the 25th day of April, 1961, the application of Ralph G. and Virginia S. Rose, as owners, for a zone variance to permit the construction of a new dwelling on the front portion of the lot, and to retain the existing dwelling on the rear portion of the lot at 535 East it Camino Real, in the City of Arcadia, County of Los An~eles, State of California, described as follows: The west 96.92 feet of the east 184.92 feet of the south one.-half of Lot 58, Tract No. 808~ 'as shown on map recorded in Book 16, pages 82 and 83, of Maps, records of said County; and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 9th day of May, which hearing was duly continued to May 23, 1961, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That there were no protests to ~he granting of the proposed variance, either oral or written, and' while no one other than applicants appeared to speak in favor of tfle variance, owners of five surrounding properties to the east, north, and west -1- 411 r/' . . . signed consent to the granting of the variance. That 'although the existing house and garage on the rear of the lot do not exactly com- ply with the present Building'Code, a report from the Chief Building Inspector stated that minor wiring, roofing, painting ,and proper venting for the kitchen range would put the house and garage in as good a condition as other small structures built in Arcadia in 1939. That plans for the proposed new house indicate ,it will have approximately 1800 square feet and that there is ample room on the , lot fo~ it to meet all yard requirements. SECTION 2. That although the property is located in an R-l Zone, the lot contains 20,959 square feet which is considerably I more area than the area required for two houses in suqh zone. That ~ of the four lots facing Camino Real in this block, two of the lots now have two rouses each. That the only Zone R-I requirement for two houses which this lot does not meet is that it has not been resubdividedj that because of the size, shape and location of the lot, resubdivision thereof is impracticable. That the foregoing constitutes an exceptional ci'rcumstance applicabl:, to subject prop- erty which does not apply generally to other properties in the same zone, and the requested variance is necessary fot the preser- vation and enjoyment of substantial property rights possessed by other property in the same zone and vicinity. That th.e granting of the variance under the conditions hereinafter recommended will . not be detrimental to the PMblic health or welfare, ~d will not be inconsistent with goodplannlng practice or with tne present or prospective development of' the neighborhood in which the property is located, but rather will increase the value of the property and upgrade the area. SECTION 3. That for the foregoing reasons, this Commis- recommends to the City Council of the City of Arcadia that a I -2- 411 . '. . . variance be granted to allow the construction of. a new dwelling at the front of the above described property and to retain the small dwelling at the 'rear of the property upon the condition that the existing building be altered and repair~d as follows: a. That minor wiring repairs and proper venting of the kitchen range be made to the satisfaction of the Build~ng Inspector. b. That the roof be recovered and the building be re- painted. . SECTION 4. The Secretary shall certify to the adoption of tl1is resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
