RESOLUTION NO. 408 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ,ZONE VARIANCE FOR THE ERECnON OF FOUR ADDITIONAL APARTMENT .UNITS AND TO USE THE EXIS~ING DRIVEWAY AND CARPORTS AT 918 WEST HUNTINGTON DRIVE. WHEREAS, there was filed with this Commission on the 27th day of March, 1961, the application of J. Ray Risser,as owner, for a zone variance to permit the erection of four additional apart- ment units at the rear of the property and to continue the use, with- out modification, of the existing driveway and covered carports on property at 918 West Huntington Drive, in the City of Arcadia, County . of Los Angeles, State of California, described as follows: The east 78.75 feet of Lot 1;1., Tract No. 2731, as shown on map recorded in Book 33, page 29, of Maps, records of said County; and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 11th day of Apri~, 1961, which hearing was duly continued to Apr1l25, 1961, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, T~ CITYPLANNING,COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: . SECTION 1. That there were no protests to the granting of the proposed variance and there were both written and oral communi- cations in favor of the variance. That although the driveways do not exactly conform to the present driveway requirements, a report from the Fire Chief stated that there was sufficient clearance for fire 1 408 v . . . '. . . trucks. That the 16 existing apartments were lawfully constructed in 1954; that more parking spaces were provided at that time than was then required by the Zoning Ordinance. SECTION 2. That the original plans for the development of the property included the four units presently requested and space was left and utility connections installed for their construc- tion at a later date. That said plans conformed with the Zoning Ordinance as the same was then in effect, and more than 20 units could lawfully have been constructed on the property at that time. That this condition constitutes an exceptional circumstance and the requested variance is necessary for the preservation and enjoy- ment of supstantial property rights possessed by other property in the same zone and vicinity. That the existing driveway is presently non-conforming only in the fact tha.t at three isolate9. pOints it is less than the required width; that because of open areas on each side, the driveway for the most part has more useable width than many conforming driveways flanked by solid walls. Th~t the grant- ing bf the variance under the conditions hereinafter recommended will not be detrimental to the publiC health or welf~re, and will not be inconsistent with good planning practice or with the present or prospective development of the neighborhood in whi,ch the prop- erty is located, but rather will add to the appearance of the prop- erty as presently developed. SECTION 3. That for the foregoing reasons, this Commission I recommends to the City Council of the City of Arcadia that a vari- ance be granted to allow the erection of four additional apartment units at the rear of the above described property and to continue the use without modification of the existing driveway and covered carports, upon the fOllowing conditions: a. That the electric service wires be raised enough to 2 408 ; ~.' 8 . . allow access of fire equipment and other services; and, b. That the additional required parking space be provided at the front of the bUilding back of the front setback .line. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 9th day of t.lay , 1961, by the following vote: AYES: Commissioners Ferguson, Michler, Rutherford and Forman .
