RESOLUTION NO. 407 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARI'ANCE FOR THE ERECTION AND OPERATION OF A GASOLINE SERVICE STATION AT THE NORTHWEST CORNER OF DUARTE ROAD AND GOLDEN WEST AVENUE. WHEREAS, there was filed with this Commission on the 5th day of April, 1961, the application of Jane C. Greer and Ora Reed Greer, as owners, for a zone variance to permit the erection and operation of a gasoline service station on property at the north- Wl;'st corner of Duarte Road Md Golden West Avenue, in the City of Arcadia, County of LOB Angeles, State of California, described as follows: . Lot 133, Tract No. 2731, as shown on map recorded in Book 33, page 29, of Maps, records of said County, excepting the north 117 feet thereof; and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 25th day of April, 1961, at which time all interested persons were given a full oppor- tunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That while there were those who spoke in favor ~ of the variance, there were many who orally protested the granting of the variance, many of these claiming that when they had signed the application for the variance they did not understand that it was for a gasoline service station. SECTION 2. That subject property is presently zoned R-3. That with the exception of the southeast and southwest corners of 1 407 ~ . . . . . . Golden West Avenue and Duarte Road which were develope~ with small commercial buildings while they were still in the unincorporated portion of Los Angeles County, the development of the entire neigh- borhood is exclusively for residential uses, the majority of them single family residences. That the recent development in the area has been for R-3 uses. That there are no exceptional or extra- orQinary circumstances applicable to the subject property that will prevent the owners thereof from de~eloping subject property for similar residential uses. That the requested variance is not neces- sary for the preservation of any property right of the applicants. SECTION 3. That the area is not in any particular need of a service station as there are already two at Baldwin Avenue and Duarte Road, the first intersection to the east. That the granting of a variance on subject property would open the way for similar requests for the other corners, and such development would be detri- mental to the property in the same neighborhood and zone. That the granting of a variance for this particular lot would in effect con- stitute spot zoning which would adversely affect the comprehensive general plan. SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council that the requested variance for the erection and operation of a gasoline service station on the property hereinabove described be denied. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission 'held on the 2 407 .
