RESOLUTION NO. 403 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE RECLASSIFICATION FROM ZONE R-l TO ZONE R-2 OF SPECIFIED PROPERTIES ABUTTING THE WEST SIDE OF HOLLY AVENUE SOUTH OF DUARTE ROAD, AND RECOMMENDING THE GRANTING OF A VARIANCE FOR R-3 USES UPON SPECIFIED CONDITIONS AFFECTING PROPERTIES NORTH AND SOUTH OF DUARTE ROAD BETWEEN HOLLY AVENUE AND BALDWIN AVENUE. WHEREAS, this Commission did, on its own motion, by Resolution Number 396 adopted December 13, 1960, institute pro- ceedings for the purpose of considering and making recommendations . concerning the reclassification from Zone R-l to Zone R-3 or to some more restrictive Zone, of the fOllowing described properties North and South of Duarte Road between Holly Avenue and Baldwin Avenue, to ~~et ~as t one-half of Lot 43 amflin- 01" 44 to 55 inclusive, Tract No. 3430,'as on Map recorded in Book 42, page 32,of records of said County; L01;S shown Maps, ", and I , Lots 1 to 4 inclusive and the north 60 feet of Lot 5, Tract No. 8487, as shown on Map recorded in Book 114, page 48,of Maps, records of said County; and . :mrl;luan t Lot 2 and all that portion of Lot I, Tract No. 4090, as shown on Map recorded in Book 43, page 47, of Maps, records of said County, lying northerly of the north line of Tract No. 6548, as shown on Map recorded in Book 82, page 45, of Maps, records of said County. to which a public hearing was, after notice as required L1 " by law, duly held for said purpose by and before this Commission on January 10, 1961, at which time all interest.ed persons were given full opportunity to be heard and to present evidence; -1- 403 . . . NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That owners of or representatives for the portions of the above described property hereinafter in this Section described requested that their properties remain in the present R-l Zone Classification until the respective owners thereof affirmatively seek its reclassification; that though general principles of planning might indicate the desirability of reclassifying said properties at this time, little useful purpose will be served by placing said property in a less re- strictive Zone contrary to the wishes of the owners when the . owners have no present plans for any different use of the proper- ties; that for the foregoing reasons this Commission recommends that the following portions of the above described properties remain in Zone R-IJ to wit: The east one-half of Lot 43, Tract No. 3430, as shown on map recorded in Book 42, page 32 of Maps, records of said County (located at 615 West Duarte Road), and Lots 1 to 4 inclusive and the north 60 feet of Lot 5. Tract No. 8487, as shown on map recorded in Book 114, page 48 of Maps, records of said County (located at 604, 612 and 620 West Duarte Road) . SECTION 2. That the follOWing portions of the above . desoribed property are zoned, developed and used for church pur- poses and no useful purpose would be served by changing the Zone , classification thereof; that for the foregoing ~eason the fOllOWing portions of the above described property should remain in their present R-2 Zone classification, to wit: ~'It! -2- ~, 403 '. . . . The west 170 feet of that portion of Lot 14 Tract No. 4090 as shown on map recorded in Book 3, page 47 of Naps, records of said countY4 lying north of the north line of Tract No. 65 8, as shown on map recorded in Book 82, page 45 of Maps, records of said County (OUr Savior Lutheran Church located at 512 West Duarte Road); and The east 436 feet of that portion of Lot 1, Tract No. 4090, as Shown on map recorded in Book 43, page 47 of Maps, records .of said countY4 lying north of the north line of Tract No. 65 8, as shown on map recorded in Book 82, page 45 of Maps, records of said County, and west of Holly Avenue (60 feet wide), excepting therefrom the south 200 feet of the east 277 feet thereof (Church of The Good Shepherd located at 400 to 436 West Duarte Road). SECTION 3. That the following portion of the above de- . scribed property, pursuant to a variance and special use p~rmit heretofore granted with respect thereto, has been completely de- veloped for and is being used for a mortuary and therefore further zoning relief is unnecessary at this time; that for this reason Lot 44 of said Tract No. 3430 should remain in its present Zone classification of R-l. SECTION 4. That the portion of the aforesaid property hereinafter in this Section described is surrounded on two sides by property zoned R-2 and developed and used for church purposes, and is directly across the street from the Holly Avenue School and playground; that said portion, consisting of two lots, is already developed with a total of five (5) single family dwellings; that the present R-l Zone classification is neither compatible . with the present development and use of the property, nor with the zoning classification, development and use of the properties West, North and East of the same. Said portions of aforesaid property, however, abut properties on the South zoned for and improved with -3- 403 '. . . . fine single qwellings; that the R-2 reclassification of the properties hereinafter in this Section described will permit the full utilization thereof in view of the Zone clas.sification and use of abutting properties West, North and East thereof, without undue detriment to the R-l properties to the South; that for the foregoing reasons, this Commission recommends the reclassification from Zone R-l to Zone R-2 of the following described portions of the above described property, to wit: . The south 200 feet of the east 277 feet of that portion of Lot 1, Tract No. 4090, as shown on map recorded in Book 43, page 47 of Maps, records of said County, l~ing north of the north line of Tract No. 6548, as shown on map recorded in Book 82, page 45 of Maps, records of said County, and west of Holly Avenue (60 feet Wide) (2 lots on Holly Avenue, south of The Church of The Good Shepherd, located at 1215 and 1223 Holly Avenue). SECTION 5. That no owner of any portion of the prop- erties hereinafter described expressed a desire to have his or her property reclassified to any Zone less than Zone R-3, and all owners thereof who expressed themselves, either orally or . in writing, insisted upon R-3 zoning; that subject property is bounded on the North by the rear of lots facing Fairview Avenue presently zoned R-3; that properties from the westerly end of the subject property to the westerly side of Baldwin Avenue are zoned for and developed to commercial uses. That although Duarte Road is a mEinEast-West thoroughfare permitting even truck travel, portions of su~ject property are improved with beautiful churches, and Duarte Road East of subject property contai~the Holly Avenue School, Arcadia High School, the Arcadia City Library, and some very fine single family residences. That although subject -4- 403 . . . . . property by reason of its proximity to commercial properties on the West and its location upon a heavily travelled street are not ideally suited for single family dwellings, its proximity to a fine residential area, churches, schools and public buildings through and to which Duarte Road serves as a principle means of access require the preservation to a reasonable degree of a residential atmosphere and less density of dwelling construction than would otherwise be proper. SECTION 6. That for the foregoing reasons this Commission recommends to the City Council that the following portions of subject property, to Wit: Lots 45 to 55 inclusive, Tract No. 3430, as shown on map recorded in Book 42, page 32 of Maps, records of said County and, Lot 2 and that portion of Lot 1, Tract No. 4090, as shown on map recorded in Book 43, page 47 of Maps, records of said County~ lying north of the north line of Tract No. 0548, as shown on map recorded in Book 82, page 45 of Maps, records of said County, and west of Holly Avenue, (60feet Wide), excepting therefrom the west 170 feet and the east 436 feet thereof, be not reclassified to a less restrictive Zone, but that a variance be granted to permit each lot thereof to be used for any purpose authorized by Division 5 of Part 5 of Chapter 2 of Article IX of the Arcadia Municipal Code upon the following conditions: a. That the southerly 12 feet of each lot or parcel facing or abutting the northerly side of Duarte Read be dedicated to the City of Arcadia for street purposes, except where dedication may already have been made. b. That the northerly 12 feet of each lot or parcel facing or abutting the southerly side of Duarte Road be dedicated to the City of Arcadia for street purposes, except where dedication may a~ready have been made. -5- 403 . . . c. That that portion of La Cadena Avenue (formerly known as El Molino Avenue) vacated by Ordinance 101, adjacent to Lot 48 of said Tract No. 3430, be dedicated to the City of Arcadia for street purposes. d. That no more than one dwelling unit be constructed or maintained for each 2000 square feet of area in any lot or parcel. e. That no dwelling unit shall contain less than 600 square feet of floor area, and all dwelling units on one lot shall contain an average of not less than 850 square feet of floor area. f. No portion of any building constructed within the front 65 feet of any lot or parcel, measured after all street dedications hereinbefore required shall have been made, shall exceed one story or 16 feet in height. other than eave g. No buildings or other structures, other than fences, walls, lighting equipment, bumper strips, landscape architectural features and uncovered automobile parking places, shall be erected or maintained with- in the rear 45 feet of any lot or parcel. h. The lot or parcel at the northwest corner of Holly Avenue and Duarte Road, known as 1115 Holly Avenue, shall comply with the set-back applicable both to Holly Avenue and to Duarte Road. i. That all fences and walls existing on any lot or parcel be made to conform in height and location with the requirements therefore specified in afore- said Division 5, Part 5, Chapter 2, Article IX of the Arcadia Municipal Code. j. That each lot or parcel of property included Within the property described in this Section may be used for any purpose hereinbefore specified upon compli- ance with each of the conditions herein set forth insofar as they affect such lot or parcel of property. 1. That the planning commission shall retain authority, without the necessity of further notice or proceedings, to make minor modifications in any of the foregoing conditions or regulations if such modifications are necessary and desirable and will never-the-less accomplish substantially the same results as will the strict adherence to the conditions and regulations herein set forth. -6- 403 ,. . .. That except as herein otherwise specifically provided, the provisions of Title 2 Division 5, Part 5, Chapter 2, Article IX of the Arcadia Municipal Code shall be applicable to all structures and uses hereafter erected or conducted upon each property used for any purpose authorized by the variance herein recommended. n. That Section 9291.2.11 of the Arcadia Municipal Code be suspended for a period of ten years from and after the effective date of the variance hereby recommended. O. That each of the foregoing conditions shall be continuing in nature and the violation of anyone or more thereof shall constitute grounds for the revocation or modifi- cation of the variance hereby recommended as to the lot or parcel with respect to which such violation occurs. . SECTION 7. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
