RESOLUTION NO. 401
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECGMMENDING THE GRANTIN.G
OF A VARIANCE TO PERMIT THE USE OF
PROPERTY AT 652 FAIRVIEW AVENUE AS A
PUBLIC PARKING LOT UPON SPECIFIED
CONDITIONS.
WHEREAS, there was filed with this Colllll\ission on the 9th
o.ay of December, 1960, the application of G. M. Shumaker, as owner,
for a zone variance to permit the use as a public parking lot of
property at 652 Fairview Avenue in said City of Arcad~a, County of
Los Angeles, State of California, described as follows:

WHEREAS, after' notice duly given a public h~aring was

dUly held on the matter by and before this Commission on the 27th
day of December, 1960, at which time all interested. persons were
given a full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION .HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That there were no protests,
written to the granting of the requested variance;

adjacent property signed the petition as favoring the variance.
SECTION 2. That subject property is presently zoned R-3;
that surrounding property .is either zoned R-3 or PR-3; that the use
of subject property as a parking lot will prOVide veh+cular circula-
tion between Fairview and Arcadia Avenues and through other parking
lots to Duarte Road; that extensive apartment develop~ent is already
completed and more planned in the Fairview area Whichiheightens the
need for more off-street parking facilities in the area.

SECTION 3. That the location of the proper~y constitutes

an exceptional circumstance and the requested variance.is necessary
for the preservation and enjoyment of substantial prop~rty rights
possessed by other property in the same zone and vicin~ty. That upon
the conditions hereinafter specified, the granting of the variance
will not be detrimental to the public health or welfare, will not be

inconsistent with good planning practice and the prese~t or prospec-
tive development of the neighborhood in which the property is
located, but rather, if the lot is developed for parking, it will
provide full circulation between Fairview Avenue and Duarte Road
.

through the various parking lots.
SECTION 4. That for the foregoing reasons, this Commis-
sion recommends to the c~ty Council of the City of Arcadia that a
variance be granted to allow the property at 652 Fairvfew Avenue to be
used asa parking lot upon the following conditions:
I. That a masonry wall be constructed along the east prop-

erty line.
2. That the Fairview Avenue frontage be landscaped in the
manner approved by the City Engineer and thereafter maintained by
the property owner.
3.
That a covenant be executed by the property owner, in

the form approved by the City Attorney, guaranteeing continued accessi-
bility through the property to and from Arcadia Avenue and from and to
Fairview Avenue.
SECTION 5. The Secretary shall certify to the adoption of

this resolution and shall cause a copy to be forwarded I to the City
Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the 27th
day of December, 1960, by the following vote:
