RESOLUTION NO. 399 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING INTERIM EMERGENCY ZONING OF M-l, CONCURRENT WITH ITS ANNExATION TO THE CITY OF ARCADIA, OF CERTAIN PROPERTY KNOWN AS-ANNEXATION NO. 22, SOUTH ARCADIA (UNINHABITED) . WHEREAS, pursuant to the Annexation of Uninh~bited Terri- , . tory Aot of 1939, as amended, the City Counoil of the City of Aroadia proposes to annex and has, on its own motion, initiated prooeedings 'for the annexation to the City of Arcadia pf oertain uninhabited territory oontiguous and adjaoent to the southerly portion of the City of Arcadia, which territory has been designated and is known as "Annexation No. 22, South Arcadia (Uninhabited)"; and, WHEREAS, Ordinance No. 760 of the City of Aroadia, as amended, as well as Chapter 2 of Article IX of the Aro,adia Municipal Code, provides that all property annexed to the City of Arcadia and not otherwise olassified concurrently with its annexation shall be classified and placed in Zone R-l; and, WHEREAS, Section 65806 of the California Go~ernment Code provides in part that in the event new territory may be annexed to the city, the legislative body to protect the publiC safety, health and welfare, may adopt, as an urgenoy measure, a temporary interim . , zoning ordinanoe prohibiting such and other uses whic4 may be in conflict with such zoning ordinance; and, WHEREAS, Section 3 of Ordinance No. 760 of the City of Arcadia, as well as Chapter 2 of Article IX of the Arcadia Munici- pal Code, provides for the zoning of unincorporated territory con- current with its annexation to the City of Arcadia; and, I -1- 399 ." WHEREAS, no portion of the property within the terri- tory above described is presently improved with or devoted exclu~ sively to R-l uses nor is it suitable for such residential uses but rather for industrial purposes, and the uses to wh~chsuch property is presently devoted would become nonconforming upon the , annexation of said property under. Zone R-l; and WHEREAS, after notice, as required byOrdinan~e No. 760, I as amended, a public hearing was duly held on the matter by and before this Commission on the 13th day of December, 1960, at which time all interested persona were given a full opportunity to be heard and to present evidence; . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION],. That there were no objections to the rezoning of the property for industrial uses; that hereinafter described is suitable for nor no part of the property I developed to R-l uses, but has been used and developed for industrial uses. SECTION 2. That for the foregoing reasons, this Commis- sion recommends that property in the County of Los Angeles, State , . of California, described as follows: Lots 4 and 5 of Tract No. 10260 per map recorded in Book 3, Page 23 of Maps in the office of I . the ReCOrder of said County; be rezoned to Zone M-l. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for~ warded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 27th day of December, 1960 , by the following vote: -2- 399 .. . -"-..:.. . . .
