RESOLUTION NO. 394 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE RECLASSIFICATION FROM ZONE R-l TO ZONES M-l AND D (ARCHITECTURAL OVERLAY) OF PROPERTY LYING EAST OF PECK ROAD IN SAID CITY AND THE GRANTING OF A SPECIAL USE PERMIT FOR THE DEVELOPMENT OF NATURAL RESOURCES. WHEREAS, the annexation to the City of Arcadia of terri- tory designated as Southeast Arcadia Uninhabited Annexation No. 15 was completed on December 24, 1956, and no portion of said terri- tory was reclassified concurrently with its annexation to the City of Arcadia; and, WHEREAS, Ordinance No. 760 of the City of Arcadia, as . amended, as well as Chapter 2 of Article IX of the Arcadia Municipal Code, provides that all property annexed to the City of Arcadia and not otherwise classified concurrently with its annexation is classi- fied and placed in Zone R-l, and only a part of the property annexed to the City of Arcadia as Southeast Arcadia Uninhabited Annexation No. 15 has been rezoned from Zone R-l; and, ! WHEREAS, this Commission did, on its own motion, by Reso- lution No. 388, adopted October 11, 1960, institute proceedings for the purpose of considering and making recommendations concerning the reclassification from Zone R-l to Zone M-2 or some more restrictive zone and for the granting of special use permits for that portion of the property not previously rezoned from Zone R-Ij and, WHEREAS, after notice required by Ordinance No. 760 of said . City, as amended, a public hearing was duly held on the matter by and before this Commission on the 26th day of October, 1960, which hear- ong was duly continued to November 9, 1960, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; -1- 394 " . . J . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That while there were no objections to the re- zoning of the property for industrial uses and there were many who spoke in favor of such rezoning, there were many objections to the granting of a special use permit for one of the requested uses of a portion of subject property for the raising of sheep; that there were some objections to a special use permit for a riding stable. SECTION 2. That no part of the property hereinafter de- scribed is suitable f?r nor developed to R-l uses; that the rezoning of said property for industrial purposes will permit the improvement and development of property that has been undeveloped; and that the granting of industrial zoning under certain conditions imposed by . an architectural overlay and the granting of special use permits with certain specified restrictions will be a benefit to the neigh- borhood and to the development of the city as a whole. SECTION 3. That for the foregoing reasons,. this Commis- sion recommends that property in the City of Arcadia, County of Los Angeles, State of California, described as follows: Lot 371 through Lot 532, inclusive; Lot 613 through Lot 776, inclusive; Lot 1010 through Lot 1019, inclusive; Lot 1252 through Lot 1261, inclusive; Lot 1487 through Lot 1496, inclusive; Lot 1720 through Lot 1729, inclusive; Lot 1952 through Lot 1961, inclusive; Lot 2183 thIUugh Lot 2192, inclusive; and Lot I!l; Chicago Park, as shown on map recorded in Book 30, page 100, of Miscellaneous Records in the office of the Recorder of said County, be rezoned to Zones M-l and D (Architectural Overlay') and that the . following restrictions should be made applicable to said property under said Zone D (Architectural overlay): a. Dedicate 20 feet for widening Peck Road except where the dedication has now been made. b. Dedicate 5 feet on each side of Clark Street. c. All buildings to be set back 10 feet from the front property lines after street dedication. -2- 394 . . . d. Along the Peck Road frontage this setQack area shall be suitably landscaped and maintained. e. All buildings to be of tilt-up concrete, concrete block or equivalent masonry construction and shall comply with the requirements of Fire Zone No. I. f. Doors and windows on the street side of a bUilding, except doors and windows used exclusively for light and ventilation, and opening directly into rooms used exclusively for business offices, shall not comprise more than ten per cent (10%) of the area of the street side of the building. No rooms on the street side of any building shall be used for storage, display or manufacturing purposes if more than ten per cent of the area of the street side of the building consists of doors and windows. No door for transporting materials or equipment into or out of the building may face Peck Road unless set back from the front property line 40 feet or more. g. Along the Peck Road frontage all parking areas for commercial and industrial vehicles and equipment shall be paved and shall be located to the rear or side of buildings. All materials and equipment stored outside a building shall be stored at the side or rear of the main building and shall be enclosed by at least a six- foot high masonry wall, and no materials stored out- side shall project above the enclosed masonry wall. h. Parking of employee and customer vehicles will be per- mitted in front of said building. i. Any work areas outside the bui]ding shall be located in the rear of said building, or at the side, and shall be enclosed with at least a six-foot masonry wall. . . SECTION 4. That this Commission recommends that a special use permit for the quarrying of rock and sand for a period of ten (10) years be granted covering the following described property: Beginning at a point in the southerly line of State Street located 400 feet easterly from Peck Road; thence southerly parallel with Peck Road to the northerly line of Dearborn Street; thence easterly along the northerly line of Dearborn Street to the present easterly Arcadia City boundary line; thence northerly and westerly along the Arcadia City boundary line to the point of beginning, upon the following conditions: a. That all operations conducted on the above-described property be conducted in compliance with all valid requirements of the Los Angeles County Air Pollution Control District. -3- 394 . . . . b. If necessity requires the installation of rock and sand processing equipment, an additional special use permit with suitable regulation shall be required. c. That a chain link wire fence of a minimum height of six feet, topped with three strands of barbed wire, or a masonry type wall of a minimum height of six feet, be installed completely around the property, except that along the northerly side of Clark Street from Cogswell Road to Durfee Road, ~aid masonry type wall shall be installed. d. All private roads connecting quarry, processing plant and stock pile shall be paved or be kept wetted down while being used, and shall be serviced and maintained so as to eliminate all dust so far as is possible. e. All excavations from an open pit shall result in a finished slope no steeper than one foot horizontal to one foot vertical. . f. All excavating operations shall be conducted only between the hours of 6:00 A.M. and 7:00 P.M., except in case of a public emergency or whenever reasonable and necessary repairs of equipment are required.. Any variation of the above-mentioned hours shall require the approval of the City of Arcadia, g. That there be a 25 foot buffer strip along the nor- therly side of Clark Street and that a row of trees be planted and maintained along this buffer strip. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia.
