A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING INTERIM
EMERGENCY ZONING OF M-l AND D
(ARCHITECTURAL OVERLAY) CONCURRENT
WITH ITS ANNEXATION TO THE CITY OF
ARCADIA OF CERTAIN PROPERTY KNOWN
AS ANNEXATION NO. 20, SOUTHEAST
ARCADIA (UNINHABITED) AND RECOD~ENDING
REGULATIONS TO BE MADE APPLICABLE UNDER

CONCERNING SPECIAL USES ON SAID
PROPER'I'Y.
WHEREAS, pursuant to the Annexation of Uninhabited Terri-
tory Act of 1939, as amended, the City Council of the City of
Arcadia proposes to annex and has, on its own motion, initiated
proceedings for the annexation to the City of Arcadia of certain
uninhabited territory contiguous and adjacent to the southeasterly
portion of the City of Arcadia, which territory has been designated
and is known as "Annexation No. 20, Southeast Arcadia (Uninhabited)",
and which territory is specifically described and bounded as
follows:

"ANNEXATION NO. 20, SOUTHEAST ARCADIA (UNINHABITED)"
TO THE CITY OF ARCADIA
Beginnlng at a point in the boundary of the City of Ar-
cadia, as same existed on July 1, 1960, (along the northwesterly
line of Peck Roaa) , said point being the point of intersection of
said boundary with the northwesterly prolongation of the north-
easterly line of Dearborn Street, 50 feet wide as shown on map of
Chicago Park, recorded in Book 30, page 100 of Miscellaneous Rec-
ords, in the offlce of the Los Angeles County Recorder; thence
southwesterly 975.40 feet more or less, along said boundary and
northwesterly line of Peck Road to a point of intersection with
the northwesterly prolongation of the southwesterly line of vacated
Randolph Street, 25 feet wide, said southwesterly line being along
the northeasterly lines of Lots I and 7 of the Coffin and Armstrong
Tract as per map recorded in Book 2, page 39 of Maps in the office
of the Los Angeles County Recorder; thence southeasterly along the
last mentioned prolongation and .southwesterly line to the north-
westerly line of Cogswell Road, 50 feet wide, as per map of Tract
No. 13286 recorded in Book 268, pages 29 to 32 of Maps in the office
of the Los Angeles County Recorder; thence northeasterly along the
northwesterly line of said Cogswell Road to a point of intersection
with the southwesterly line of Clark Street, 50 feet wide as shown
on said map of Chicago Park; thence southeasterly along the south-
westerly line of said Clark Street to a point of intersection with
the existing boundary of said City of Arcadia; thence northeasterly
and northwesterly along said boundary to the point of beginning;
and.

~EREAS. Ordinance No. 760 of the City of Arcadia, as
amended, as well as Chapter 2 o~ Article IX of the Arcadia Municipal '
Code, prov~des that all property annexed to the, City of Arcadia and
not otherw~se classified concurrently with its annex~tion shall be
classified' and placed in Zone R-l; and,
WHERE~S, Section 65806 of the California Government Code
provides in part that in the event new territory may be annexed to
.
the city, the legislative body to protect the public safety,'health
and" ~elfare, may adoI?t, as an urgency measure, a temporary, interim
.
zoning ord~nan~e prohibiting such and other uses which may be in'
conflict w~th such zoning ordinance; and,
WHEREAS, Section 3 of Ordinance No. 760 of the City of
Arcadia, as well as Chapter 2 of Article IX of the Arcadia Municipal
. Code, provides for the zoning of unincorporated territory concurrent
with its annexation to the City of Arcadia; and,
WHEREAS, no portion of the property within the territory
above described is presently improved with or devoted exclusively
to R-l uses nor is it suitable for such residential uses but rather
for i~dustrial purposes; and the uses to which such property is
presently devoted would become nonconforming upon the annexation of
said property; and,
WHEREAS, after notice as required by Ordinance 'No. 760, as
amended, a public hearing was duly held on the matter by and before
this Commission on the 26th day of October, 1960, Which hearing was
duly continued to November 9, 1960, at each of which times all in-
.
terested persons,were given a full opportunity to be heard and to
present evidence;
}jQW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS ~
SECTION 1. That while there were no objections to the re-
zoning of the property for industrial uses and there were many who

. spoke in favor of such rezoning, there were many objections to the
granting of a special use permit for one of the requested uses of
a portion of subject property for the raising of sheep; and that
there were some objections to a speclal use permit for a riding
stable.
SECTION 2. That no part of the property hereinabove de-
.
scribed is suitable for nor developed to R-l uses; that the rezon-
ing of said property for industrial purposes will permit the
improvement and development of property that has been undeveloped;
that the ,granting of industrial zoning under certain conditions
imposed by an architectural overlay and the granting of special use
permits with certain specified restrictions will be a benefit to
the neighborhood and to the development of the city as a whole.
SECTION 3. That for the foregoing reasons, this Commis-
sion recommends that the property hereinabove described be placed
in Zone M-l and in Zone D (Architectural Overlay) and that the fo]-
lowing restrictions should be made applicable to said property under
said Zone D (Architectural Overlay):
a. Dedicate 20 feet for widening Peck Road except where
the dedication has now been made.
b. Dedicate 5 feet on each side of Clark Street.
c. All buildings to be set back 10 feet from property
lines after street dedication.

d. Setback area shall be suitably landscaped and main-
tained along the Peck Road frontage.
e. All buildings to be of tilt-up concrete, concrete
block of equivalent masonry construction and to
comply with the requirements of Fire Zone No.1.
f. Doors and windows on the street side of a building,
except doors and windows used exclusively for light
and ventilation and opening directly into rooms used
exclusively for business offices, shall not comprise
more than ten percent (10%) of the area of a street
side of the building. No rooms on the street side of
any building shall be used for storage, display or
manufacturing purposes if more than ten percent (10%)
of the area of the street side of the building consists

of doors and windows. No door for transporting
materials or equipment into or out of the building
may face Peck Road unless set back from the front
property line 40 feet or more.
g. Along the Peck Road frontage all parking areas for
commercial and industrial vehicles and equipment
shall be paved and shall be located t9 the rear or
side of buildings. All materials and equ~pment
stored outside a-building shall be stored at the
side or rear of the main building and shall be en-
closed by. at least a six-foot high masonry wall, and
no materials stored outside shall project above the
enclosed masonry wall.
h. Parking of employee and customer vehicles will be
permitted in front of said building.
i. Any work areas outside the building shall be located
in the rear of said building, or at the side, and
shall be enclosed with at least a six-foot masonry
wall.
SECTION 4. That this Commission recommends that a special

use permit be granted to allow a riding academy or boarding stable
for a period of not to exceed ten (10) years, subject to adequate
enforcement of sanitation and health regulations, on the following
portion of the property described in Section 1 hereinabove:
That property bounded on the North.by Dearborn
Street, on the East by Myrtle Avenue, on the South
by Clark Street and on the West by Peck Road.
SECTION 5. That this Commission recommends that a special
use permit for the quarrying of rock and sand for a period of ten
(10) years be granted covering the following portion of the property
described in Section 1 hereinabove:

Beginning at the intersection of the northerly
line of Dearborn Street with the easterly line
of Myrtle Avenue; thence southerly along said
easterly line of Myrtle Avenue to the northerly
line of Clark Street; thence easterly along the
said northerly line of Clark Street to the present
easterly Arcadia City boundary; thence northerly
thereon to the northerly line of Dearborn Street;
thence.westerly thereon to the point of beginning,
upon the following conditions:
a. That all operations conducted on the above-described
property be conducted in compliance with all valid
requirements of the Los Angeles County Air Pollution
Control District.

b. If necessity requires the installation of rock and
sahd processing equipment, an additional special
use permit with suitable regulation shall be required.

c. That a chain link wire fence of a minimum height of
six feet, topped with three strands of barbed wire,
or a masonry type wall of a mtnimum height of six
feet, be installed completely around. the property,
except that along the northerly side of Clark
Street from Cogswell Road to Durfee Road, said
masonry type wall shall be installed.
d. All private roads connecting quarry, processing
plant and stock pile shall be paved or be kept
wetted down while being used, and shall be serviced
and maintained so as to eliminate all dust so far
as is possible.
e. All excavations from an open pit shall result in
a finished slope no steeper than one foot horizontal
to one foot vertical.

f. All excavating operations shall be conducted only be-
tween the hours of 6:00 a.m. and 7:00 p.m., except
in case of a public emergency or whenever reasonable
ahd necessary repairs of equipment are required. Any
variation of the above-mentioned hours shall require
the approval of the City of Arcadia.
g. That there be a 25-foot buffer strip along the northerly
side of Clark street and that a row of trees be planted
and maintained along this buffer strip.
SECTION 6. The Secretary shall certify to the adoption
of this resolution and shall cause a copy of the same to be forwarded
to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the
9th day of November, 1960, by the following vote:
AYES: Commissioners Ferguson, Golisch, Rutherford and
Forman
