A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMl'IENDING T}ffi GRANTING OF A ZONE VARIANCE TO PERMIT STRUCTURAL ALTERATIONS AND ADDITIONS TO PROPERTIES ABUTTING THE NORTH SIDE OF HUNTINGTON DRIVE BETVffiEN SANTA ANITA AND FIRST AVENUES IN SAID CITY UNDER SPECIFIED CONDITIONS. THE CITY PLANNING COMMISSION OF T}ffi CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That portions of the business district of the City of Arcadia were developed and improved prior to the enact- ment of the zoning regulations applicable to said properties. That . the strict apPlication of such zoning regulations to properties that were improved prior to the enactment thereof have tended to retard rather than promote the further development of said proper- ties and have hindered rather than encouraged their fullest, best and highest use. That, because of the foregoing this Commission did, at the request of the Arcadia City Council, initiate proceed- ings pursuant to Resolution No. 372 for the purpose of considering and making recommendatiohs concerning the amendment of Ordinance No. 760 of said City by amending Sections 15 and 16 thereof and any other pertinent sections so as to permit structural alterations of and additions to nonconforming buildings under specified condi- tions and to permit the Modification Committee to grant minor modi- fications of the parking requirements applicable thereto, pursuant . to which a publiC hearing thereon was duly held by and before this Commission on April 26, 1960, which hearing was from time to time duly continued to September 27, 1960, at each of which hearings all interest persons were given full opportunity to be heard and to present evidence. SECTION 2. That this Commission thereupon determined although problems exist in portions of the City resulting in . . -1- 392 ~ I. . . 1 . . large part from the application of regulations concerning yard re- quirements, off-street parking and parking access, many of which were enacted subsequent to the construction of buildings in such portions of the City, such regulations for the most part constitute good zoning practice and their amendment to provide relief for specific portions or' the City will undermine the entire regulatory structure with respect to the balance of the City. That the prob- lem areas can better be dealt with by the granting of variances for the respective areas rather than by the amendment of the regulat- tions themselves, and this Commission therefore recommended that no amendments to Ordinance No. 760 be made as a result of the pro- ceedings instituted by this Commission under and pursuant to its said Resolution No. 372, and that the proceedings instituted by this Com- mission by its said Resolution No. 372 be terminated. That thereupon the City Council by its Resolution No. 3312 did terminate the pro- ceedings instituted by this Commission by its Resolution No. 372. SECTION 3. That the present parking requirements and re- strictions as to setbacks, alleys and parking lot access have so restricted the enlargement, alteration and modernization of exist- ing buildings and retarded the construction of new buildings on Lots 1 to 17, inclusive, Block 74, Santa Anita Tract, per map re- corded in Book 15, pages 89 and 90, of Miscellaneous Records of Los Angeles County, situated on the north side of Huntington Drive between Santa Anita Avenue and First Avenue, as to preclude the full or proper utilization of said properties and of the off-street park- ing facilities heretofore provided in connection therewith, That the majority of the existing buildings on said lots were constructed thereon before the regulations presently in effect were established; that the strict adherence to all regulations presently applicable to aforesaid properties will further retard rather than foster the mod- ernization of the existing structures and the fullest and best use of the above described pr~erties, and will not best accomplish the aims and purposes of the overall purpose of aforesaid regulations. -2- 392 . . . . . . SECTION 4. That because of such practical difficulties, unnecessary hardships, and results inconsistent with the general provisions of Ordinance No. 760 of the City of Arcadia, as amended, said Ordinance No. 760, as amended, now being contained in Chapter 2 of Article IX of the Arcadia Municipal Code, this Commission did, on its own motion, initiate proceedings for the purpose of consid- ering and maKing recommendations concerning the granting of a vari- ance from the setback, alley, parking and parking lot access regu- lations applicable to the property described in Section 3 hereof', pursuant to which a public hearing was duly held by and before this Commission on November 9, 1960, at which time all interested persons were given full opportunity to be heard and to present evidence. SECTION 5. That the i'acts found to be true in Sections 1 and 3 hereof constitute exceptional or extraordinary circumstances or conditions applicable to the property or class of use in the same zone or vicinity; that the granting of a variance as hereinafter recommended will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located; that such vari- ance is necessary for the preservation and enjoyment of a substan- tial property right of the property owners involved possessed by other properties in the same vicinity and zone. That the granting of such a variance will not adversely affect the comprehensive general plan. SECTION 6. That for tre foregoing reasons this Commission recommends to the City Council of the City of Arcadia that a vari- ance be granted to permit structural alterations and additions to the properties abutting the north side of Huntington Drive between Santa Anita Avenue and First Avenue in the City of Arcadia and more particularly described in Section 3 hereof, upon the following terms and conditions: -3- 392 .. , . . . . . a.
